我国产品生态设计法律保障研究

【摘要】：产品生态设计是相比较传统的产品设计而提出的一个新的概念,它将环境因素考虑到产品的生产设计中,旨在改善产品在整个生命周期内的性能,降低其环境影响,实现从源头预防污染的目的。在传统的产品设计中,产品的生命周期一般被定义为：资源——产品——废弃物。这种追求单一线性经济的生产模式带来了许多环境污染和资源的浪费。而在生态设计理念的指引下,一个产品的生命周期将处于循环经济的模式下,即：生态设计——产品——循环处理。践行生态设计不仅有助于降低企业成本、改善企业形象,而且现在已经成为企业进入市场的通行证。面对日益严峻的环境形势,政府、供应商和消费者都对企业提出了更高的环境要求。完善我国产品生态设计法律制度,不仅为经济与环境的协调发展提供制度保障,也为产品生态设计在国内的实施提供决策依据,这也就成为本文写作的根本意义所在。 本文主要分为以下几部分： 引言部分主要通过人类面临的生态危机引出生态设计的理念,详细叙述了研究产品生态设计极其法律制度的意义,以及国内外对此问题的研究现状。 第一部分主要是对产品生态设计的概述,通过引用不同学者对生态设计、产品生态设计的定义进行了分析,得出了作者自己的定义。并且对产品生态设计的产生背景进行了简要介绍。 第二部分从生态哲学角度、经济学角度以及法学角度论述了立法推进产品生态设计制度的理论基础。并且对最后的生产者责任进行了详细的论述。 第三部分是对我国产品生态设计制度法律保障的现状进行了叙述,并对所面临的困境进行了分析,如管理体制的欠缺、技术的障碍及缺乏完善的经济激励机制和奖惩制度等,说明我国的生态设计制度需要法律制度的构建。 第四部分并着重考察了国外产品生态设计的立法体制以及对我国产品生态设计法律制度的启示。 第五部分是对建立和完善我国产品生态设计法律制度的构想。除了构建完善的法律体制外,还提出了合作机制,以期使我国的产品生态设计法律制度更加完善。
[Abstract]:Product ecological design is a new concept compared with traditional product design. It takes environmental factors into account in product production design, and aims to improve the performance of products throughout their life cycle and reduce their environmental impact. To achieve the goal of preventing pollution from the source. In traditional product design, product life cycle is generally defined as: resource-product-waste. The pursuit of a single linear economy has brought a lot of environmental pollution and waste of resources. Under the guidance of the concept of ecological design, the life cycle of a product will be in the mode of circular economy, that is, ecological design-product-recycle treatment. The practice of ecological design not only helps to reduce the cost and improve the image of enterprises, but also has become the passport for enterprises to enter the market. Faced with the increasingly severe environmental situation, the government, suppliers and consumers have put forward higher environmental requirements for enterprises. Perfecting the legal system of product ecological design in China not only provides the system guarantee for the coordinated development of economy and environment, but also provides the decision basis for the implementation of product ecological design in China. This paper is mainly divided into the following parts: the introduction mainly introduces the concept of ecological design through the ecological crisis faced by human beings, and describes in detail the significance of studying the ecological design of products and its legal system. And the domestic and foreign research on this issue. The first part is an overview of the ecological design of products. The definition of ecological design and product ecological design is analyzed by citing different scholars, and the author's own definition is obtained. The background of product ecological design is briefly introduced. The second part discusses the theoretical basis of legislation to promote the system of product ecological design from the angle of ecological philosophy, economics and law. And the final producer responsibility is discussed in detail. The third part is to describe the current situation of the legal protection of the system of product ecological design in China, and to analyze the difficulties, such as the lack of management system, the technical obstacles and the lack of perfect economic incentive mechanism, reward and punishment system, and so on. It shows that the ecological design system of our country needs the construction of legal system. The fourth part focuses on the legislative system of foreign product ecological design and the enlightenment to the legal system of product ecological design in China. The fifth part is to establish and perfect the legal system of product ecological design. In addition to constructing a perfect legal system, it also puts forward a cooperative mechanism in order to make the legal system of product ecological design more perfect.
