《反恐怖主义法》中帮教、矫正制度的落实路径——解读《反恐怖主义法》第二十九条

【摘要】：2016年1月1日《中华人民共和国反恐怖主义法》(下文简称《反恐怖主义法》)颁布并施行。该法共十章、九十七条,就我国反恐工作的原则、调查、处置、保障等各方面进行了全面的规定,其中第三章安全防范的第二十九条对恐怖活动中的胁从犯和尚不构成恐怖犯罪的轻微犯做出了帮教的规定,对服刑的恐怖分子进行矫正的要求。2016年3月22日的比利时机场恐怖爆炸案,对全世界的反恐工作又一次发起了挑战。面对日益严峻的反恐形势,如何有效地对胁从犯、轻微犯进行帮教?如何对恐怖分子进行矫正教育?这些问题必须重视起来。借鉴国外的先进理念,结合我国的社会现状,可提出以下途径:明确落实主体,推广帮教、矫正一体化;丰富落实方式,推进帮教、矫正高效性;加强落实监督,推动帮教、矫正持续性。
[Abstract]:The Anti-Terrorism Law of the people's Republic of China (hereinafter referred to as the Anti-Terrorism Law) was promulgated and implemented on January 1, 2016. The law contains 10 chapters, 97 articles, and makes comprehensive provisions on the principles, investigation, disposal, protection and other aspects of China's counter-terrorism work. Article 29 of Chapter III on security precautions provides for the help and education of minor criminals who commit a terrorist act and do not constitute a terrorist crime by accomplishing accomplices and monks in terrorist activities. The terrorist bombing at Belgium's airport on March 22, 2016, is yet another challenge to counter-terrorism efforts around the world. In the face of the increasingly severe anti-terrorism situation, how to effectively help and educate accomplices and minor offenders? How to educate terrorists about correction? These problems must be taken seriously. Drawing lessons from the advanced ideas of foreign countries and combining the social situation of our country, we can put forward the following ways: to make clear the main body, to promote the help and education, to rectify the integration; to enrich the implementation way, to promote the help and teaching, to correct the high efficiency; to strengthen the implementation supervision; to promote the help and education; Corrective persistence.
