软法视角下的全民阅读立法研究

【摘要】：自"开展全民阅读活动"写入党的十八大报告后,《全民阅读促进条例》呼之欲出,全民阅读立法步入快车道。与运用国家强制力保证实施的硬法不同,阅读权的实现主要依赖宣传、鼓励权利主体自我选择,是一种软法规范。以软法为框架,分析《全民阅读促进条例》(征求意见稿)和《深圳经济特区全民阅读促进条例》等法规发现,目前中国全民阅读立法可分为三类,均具有软法规范属性,在权利义务责任配置和公共资源配置方面产生实际效力。基于全民阅读立法的软法属性,今后应通过"软硬"混合方式,完善政府问责和评估体系、引导公众自主实现阅读权利、促进社会多元主体共同推进全民阅读、建设书香社会。
[Abstract]:Since the National Reading activity was written into the report of the 18th National Congress of the Communist Party of China, the "regulations on the Promotion of National Reading" are ready to emerge, and the legislation on universal reading has entered the fast lane. The realization of reading right depends mainly on propaganda and encourages the right subject to choose itself, which is a kind of soft law norm. Taking soft law as the framework, this paper analyzes the regulations on the Promotion of National Reading (draft for consultation) and Shenzhen Special Economic Zone on the Promotion of National Reading. It is found that at present, the legislation on universal reading in China can be divided into three categories, all of which have the attributes of soft law norms. In the rights and obligations of the allocation and allocation of public resources to produce practical effect. Based on the soft law attribute of universal reading legislation, we should perfect the system of government accountability and evaluation, guide the public to realize the reading right independently, promote the pluralistic subjects of the society to promote the reading of the whole people and build the book-fragrant society through the mixed way of "soft and hard" in the future.
