国家监察体制改革背景下行政监察制度的转型

【摘要】：国家监察体制改革助推从行政监察到国家监察的制度升级,接踵而至的是行政监察制度的存废问题。作为行政系统内部的一种专门监督方式,行政监察因其专业性、综合性和实体性等特征,具有其他监督方式不可替代的重要作用。为顺应国家监察体制改革,行政监察在体制上应改双重领导为垂直领导,增强行政监察的独立性;在职能上应从侧重对人监督转向对事监督,强化执法监察和效能监察职能;在机构上应整合行政监察和审计机关,组建监审合一的监督机构。行政监察制度的转型当以修订《行政监察法》为保障,立足长远则应适时制定一部统领行政监察和审计监督的法律。
[Abstract]:The reform of the state supervision system promotes the upgrading of the system from administrative supervision to state supervision. As a special supervision method in administrative system, administrative supervision plays an irreplaceable role because of its professional, comprehensive and substantive characteristics. In order to comply with the reform of the national supervisory system, the administrative supervision should change from double leadership to vertical leadership, strengthen the independence of administrative supervision, shift from focusing on supervision of people to supervision on matters, strengthen the functions of law enforcement supervision and efficiency supervision. The administrative supervision and audit institutions should be integrated in the organization, and the supervision organization should be set up. The transformation of the administrative supervision system should be guaranteed by the revision of the Administrative Supervision Law. In the long run, a law governing administrative supervision and audit supervision should be formulated in good time.
