我国社会保障法实施中的障碍及对策研究

【摘要】：在我国加入国际世界贸易组织以后,我国的保险业已经逐渐地与国际市场接轨。很多国内外的企业都对我国的保险业市场产生了兴趣,在这样的发展背景和发展趋势的助推下,我国保险业也已经面临了巨大的挑战。因此,我国的保险业必须要进行自我规范和自我完善,通过法律制度的完善和贯彻实施,谋求更大的发展空间和更广阔的发展市场。在和平发展的时期,经济发展的地位尤为突出,要实现经济的快速发展,就要逐步建立权利公平、机会公平、规则公平、分配公平为主要内容的社会公平保障体系,完善社会保险制度,消除人民参与经济发展、分享经济发展成果方面所面临的障碍。社会保险法就是在这样的经济发展方面的新理念的指导下制定和实施的。由此也可以看出,对我国社会保险法实施中的障碍进行研究,并提出相应的解决对策,是具有重要性和必要性的。实际上,我国的社会保险制度改革自1991年6月,国务院发布《关于企业职工养老保险制度改革的决定》开始,至今已经进行了二十余年了,在此期间我国已经基本形成了一个以基本养老保障、基本医疗保险、工伤与生育保险、失业保险、社会福利服务以及社会救助制度等为基本内容的制度雏形。在2010年10月28日,十一届全国人大常委会第十七次会议经表决通过了保险法,在一定程度上推动了我国社会保险制度改革的进程,促进我国社会保险制度的进一步完善。本文以我国社会保险法实施中的障碍及对策研究为课题,主要可以分为四个部分。第一个部分是对我国社会保险法的基本概述,主要从我国社会保险法的产生及发展历程、基本特点、立法原则、重要意义等四个方面对保险法进行基本的概括；第二部分是我国社会保险法的基本框架及制度创新,具体阐述我国保险法的内容,以及保险法的创新之处,对保险法的概括更加的明确。第三部分是论述我国社会保险法实施中的障碍,这是全文的重点和难点部分,总结出的障碍具体分为四个方面：即为缺乏实际操作性、实施存在差异性、法律体系不够完善、缺少完善的监督机制；第四部分是对我国社会保险法实施中的对策研究,具体概括为：进一步完善我国现行的社会保险法、认真做好社会保险法的贯彻实施工作、积极完善我国社会保险法律制度、努力健全我国社会保险法的监督机制。
[Abstract]:After China's entry into the World Trade Organization (WTO), China's insurance industry has gradually been in line with the international market. Many enterprises at home and abroad are interested in the insurance market of our country. With the help of the development background and development trend, the insurance industry of our country has also been faced with enormous challenges. Therefore, our country's insurance industry must carry on the self-regulation and the self-perfection, through the legal system consummation and the implementation, seeks for the bigger development space and the broader development market. In the period of peaceful development, the position of economic development is particularly prominent. In order to achieve rapid economic development, we must gradually establish a social equity guarantee system with equal rights, fair opportunities, fair rules, and fair distribution. To improve the social insurance system and eliminate the obstacles faced by the people in participating in economic development and sharing the fruits of economic development. The social insurance law is formulated and implemented under the guidance of such a new concept of economic development. Therefore, it is important and necessary to study the obstacles in the implementation of social insurance law and put forward corresponding countermeasures. In fact, the reform of China's social security system has been under way for more than 20 years since June 1991, when the State Council issued a decision on the reform of the old-age insurance system for enterprise workers. During this period, China has basically formed a basic system of old-age security, basic medical insurance, industrial injury and maternity insurance, unemployment insurance, social welfare services and social assistance system as the basic content of the system. On October 28, 2010, the 17th meeting of the standing Committee of the Eleventh National people's Congress passed the Insurance Law, which to some extent promoted the process of the reform of the social insurance system in China and promoted the further improvement of the social insurance system in our country. This paper focuses on the study of obstacles and countermeasures in the implementation of social insurance law, which can be divided into four parts. The first part is the basic overview of China's social insurance law, mainly from the emergence and development of China's social insurance law, the basic characteristics, legislative principles, significance and other four aspects of the basic summary of the insurance law; The second part is the basic framework and system innovation of the social insurance law of our country. The content of the insurance law of our country and the innovation of the insurance law are elaborated in detail, and the summary of the insurance law is more clear. The third part discusses the obstacles in the implementation of the social insurance law in China, which is the key and difficult part of the full text. The obstacles summarized are divided into four aspects: lack of practical operation, differences in implementation, imperfect legal system. The fourth part is a study on the countermeasures in the implementation of the social insurance law in China, which is summarized as follows: further improving the current social insurance law, doing a good job in the implementation of the social insurance law, We should actively improve our social insurance legal system and strive to improve the supervision mechanism of our country's social insurance law.
