论我国技术侦查措施的完善

【摘要】：技术侦查措施作为一种特殊的侦查手段是侦查机关在侦查一系列高科技犯罪实践过程中产生出来的,随着科学技术在犯罪领域里的深度渗透和高度融合,一方面犯罪分子能够轻易的超越传统的作案方式来达到犯罪的目的,另一方而,这种高科技犯罪也给侦查机关破案增加了一定的难度。高科技犯罪的出现和增多,也迫使侦查机关必须掌握更为先进的技术手段来打击和预防此类犯罪。而巧合的是,传统的逆向侦查理念和办案方式也呈现出逆向侦查和顺向侦查并重的新特点,这一因素也在某种程度上加快了技术侦查措施的快速发展。从近年来各国的侦破案例来看,利用先进的科学技术手段侦破高科技犯罪已然成了一种新的趋势,这不仅有利于节约各种司法资源和社会成本,而且还能有效的遏制高科技犯罪保障社会公平正义。而科技更新时间的缩短,也无一例外的波及到了毒品犯罪、团伙犯罪以及其他重大犯罪,这也迫使各个国家采用新型的技术手段和侦查方法来侦破这些重大犯罪。随着科学技术与侦查理论的相互融合以及技术侦查措施在侦查实务中不断的完善和发展,理论界也开始关注技术侦查这一课题。本文共分为五个部分对技术侦查措施的内涵与外延、运用与发展做了初步的探析,对国外技术侦查措施的立法、案例进行了比照以及在此基础之上介绍了我国技术侦查措施立法的现状和完善构想。
[Abstract]:As a special investigative means, technical investigation measures are produced by investigative organs in the course of investigating a series of high-tech crimes. With the deep penetration and integration of science and technology in the field of crime, On the one hand, criminals can easily go beyond the traditional ways to achieve the purpose of crime. On the other hand, this high-tech crime also increases the difficulty of investigating organs to solve cases. The emergence and increase of high-tech crime also force the investigation organization to master more advanced technical means to combat and prevent this kind of crime. Coincidentally, the traditional concept of reverse investigation and the way of handling cases also show the new characteristics of both reverse investigation and forward investigation. This factor also speeds up the rapid development of technical investigation measures to some extent. According to the cases of various countries in recent years, it has become a new trend to use advanced scientific and technological means to solve high-tech crimes, which is not only conducive to saving various kinds of judicial resources and social costs. And also can effectively curb high-tech crime to ensure social fairness and justice. And the shortening of the time of scientific and technological renewal, without exception, spread to drug crimes, gang crimes and other major crimes, which also forced each country to use new technical means and methods of investigation to detect these major crimes. With the mutual integration of science and technology and investigation theory and the continuous improvement and development of technical investigation measures in investigation practice, the theoretical circle has begun to pay attention to the subject of technical investigation. This paper is divided into five parts: the connotation and extension of the technical investigation measures, the application and development of the preliminary analysis, the legislation of foreign technical investigation measures, On the basis of the comparison, the paper introduces the present situation and the perfect conception of the legislation of technical investigation measures in our country.
