地方执法评估体系研究

【摘要】：法治评估是顺应法治发展需求而产生的新生事物。为了衡量法治政府建设水平,找准法治发展中出现的问题,我国在行政领域内的法治评估活动也如火如荼地开展起来。行政执法向来是法治政府建设中较为薄弱的环节,但目前却没有专门针对地方执法而设定的法治评估。种类繁多的执法部门以及执法内容的复杂多样使得地方执法评估成为了法治评估大背景下的真空地带。本文通过对比借鉴WJP、“法治余杭”、《中国法治政府评估报告》的法治评估实践,谋求建立一个全方位、多角度、可视化的地方执法评估体系,力求为地方政府,特别是基层执法部门进行法治评估提供切实可靠的方法。在评估指标选择上,本文共设置执法体制、执法程序、执法方式、执法责任制、执法人员、执法体验、执法救济、执法保障、具体执法行为等9项一级指标,下设47项二级指标,并详细阐述了指标设定目的、主要观察点和评分标准。除符合普适性、客观性、可操作性等要求外,更加注重体现法治内涵和地方执法特色。
[Abstract]:The evaluation of rule of law is a new thing to meet the needs of the development of the rule of law. In order to measure the level of government by law and find out the problems in the development of the rule of law, the evaluation of the rule of law in the field of administration has been carried out in full swing in our country. Administrative law enforcement has always been a weak link in the construction of the government ruled by law, but at present there is no evaluation of the rule of law set for local law enforcement. With the variety of law enforcement departments and the complexity of law enforcement content, local law enforcement evaluation has become a vacuum zone under the background of rule of law evaluation. In this paper, the author tries to establish a comprehensive, multi-angle and visualized evaluation system of local law enforcement by comparing the practice of "Yuhang of Rule of Law" and "Evaluation report of Chinese Government by Rule of Law" of WJP, in order to serve the local government. In particular, law enforcement departments at the grass-roots level to evaluate the rule of law to provide a practical and reliable method. In the selection of evaluation indicators, this paper sets up nine first-level indicators, such as law enforcement system, law enforcement procedure, law enforcement method, law enforcement responsibility system, law enforcement personnel, law enforcement experience, law enforcement relief, law enforcement protection, specific law enforcement behavior, etc. There are 47 second-level indexes, and the purpose, main observation points and scoring criteria are described in detail. Besides the requirements of universality, objectivity and maneuverability, we should pay more attention to embody the connotation of rule of law and local law enforcement characteristics.
