论城管暴力执法的成因和对策

【摘要】：城管执法是我国近年来受到社会广泛关注的重大事件，仅2013年一年就有十多起城管暴力执法的事件被报道出来，引起了很大的社会反响。暴力执法是城管执法过程中出现的违反相应的法律、法规等对相对人使用暴力手段的情况，造成相对人财产损失，生命健康及自由等权利受到损害的情况。本文就是在这样的背景，讨论城管暴力执法的成因和对策，在分析暴力执法的基本理论的基础上，按照发现问题、解决问题的线索来展开对整个论文的讨论。我国城管队伍产生于上个世纪我国改革开放以后的城市转型期，其是在特定的历史背景下产生的，对我国城市的建设和发展作出了重要的贡献。在我国大城市的转型期，社会结构发生了重大的变化，城乡之间的隔阂越来越少，大量的人口流动产生，城市成为了人口流动的重要场所。这给城市的发展和建设提供了大量的劳动力的同时，带来了人口过剩的情况，城市中出现了大量的下岗人员，为了谋生，大量的违法乱纪摆地摊现象大量的存在。“城市病”成为城市发展中遇到的重要问题，城管队伍在解决我国城市发展中遇到的问题发挥了很大的作用，对整治违法乱纪的现象有重要的意义。自上个世纪九十年代我国正式建立起城管执法队伍，尽管其在城市管理中发挥了重大的作用，但是近年来发生的许多事件中也反映出了其存在着暴力执法的问题。本文通过三个部分对我国的暴力执法进行了介绍：城管暴力执法的概述，这一部分是本文的基础和前提，为下文的展开铺垫了基础，在这一部分笔者分析了城管的概念，具体的介绍了城管产生的背景，并结合相关的规定分析了其概念；介绍了城管执法的概念在此基础上介绍了暴力执法执法的概念。介绍了暴力执法表现形式，及其存在的危害，全面的介绍了城管暴力执法；第二部分介绍了城管暴力执法的现状和成因，在第一部分的基础上，介绍了城管暴力执法的现状，详细的结合了我国的实践分析了存在的违反法律程序、群众参与度不高、权责不清、城管执法手段单一、暴力执法现象比较突出等现状，并分析了产生这些现状的原因，利益冲突、权力和权利的冲突、城管制度存有缺陷等等，这一部分是本文重点和难点；第三部分，介绍了降低城管暴力执法的对策，针对上文提出的城管暴力执法的现状，，提出了完善城管执法的建议，为城管执法完善的相关的建议。本文的三个部分紧紧围绕分析现状、发现问题和解决问题的线索对城管暴力执法展开，结合我的执法实践以及我国的近年来发生的暴力执法进行了深入的分析，在基础理论的基础上，分析了导致暴力执法的现状以及暴力执法出现的原因，并针对存在的问题提出了相关的对策的。为了促进我国城管执法的进步和完善，对目前其存在的严重的暴力执法的现象进行了深入的分析。
[Abstract]:Urban management law enforcement is a major event that has received extensive attention in China in recent years. In 2013 alone, more than a dozen incidents of urban management violence law enforcement were reported, which caused great social repercussions. Violent law enforcement is the violation of the corresponding laws and regulations in the process of urban management law enforcement, such as the use of violent means against the relative person, which results in the loss of property, life, health and freedom of the relative person. This article is in this background, discusses the causes and countermeasures of urban management violence law enforcement, on the basis of the analysis of the basic theory of violence law enforcement, according to the discovery of problems, problem-solving clues to the entire discussion of the paper. The urban management team of our country came into being in the urban transition period after the reform and opening up of our country in the last century, it is produced under the specific historical background, has made the important contribution to the construction and the development of our country city. In the transition period of big cities in our country, the social structure has undergone great changes, the gap between urban and rural areas has become less and less, a large number of population flows have emerged, and cities have become an important place for population mobility. This provides a large number of labor force for the development and construction of the city, at the same time brings the situation of overpopulation, there are a large number of laid-off workers in the city, in order to earn a living, a large number of illegal law and order phenomenon exists. "Urban disease" has become an important problem in urban development. Urban management team has played a great role in solving the problems encountered in the urban development of our country, and it is of great significance to rectify the phenomenon of violation of law and discipline. Since the 1990s of last century, China has formally established the urban management law enforcement team, although it has played an important role in urban management, but in recent years, many incidents have also reflected the existence of violent law enforcement problems. This article has carried on the introduction to our country's violent law enforcement through three parts: the summary of the urban management violence law enforcement, this part is the foundation and the premise of this article, has laid the foundation for the following development, in this part the author has analyzed the urban management concept, This paper introduces the background of urban management, and analyzes the concept of urban management in combination with the relevant provisions, and introduces the concept of urban management law enforcement on the basis of which the concept of violent law enforcement is introduced. This paper introduces the manifestation of violent law enforcement and its harm, introduces the law enforcement of urban management violence in an all-round way; the second part introduces the current situation and causes of urban management violence law enforcement, on the basis of the first part, introduces the current situation of urban management violence law enforcement. Combining the practice of our country in detail, this paper analyzes the existing situation of violating the legal procedure, the participation of the masses is not high, the power and responsibility are not clear, the law enforcement means of urban management are single, the phenomenon of violent law enforcement is relatively prominent, and the reasons for these present situations are analyzed. Conflicts of interest, conflicts of power and rights, defects in urban management system, etc. This part is the focus and difficulty of this paper. The third part introduces the countermeasures to reduce the law enforcement of urban management violence, aiming at the current situation of urban management violence law enforcement proposed above. Put forward the suggestion of perfecting the urban management law enforcement, for the relevant suggestion of the city management law enforcement perfection. The three parts of this paper focus on the analysis of the current situation, discover the problems and solve the problems of urban management violence law enforcement, combined with my law enforcement practice and our country in recent years of violence law enforcement in-depth analysis, On the basis of the basic theory, this paper analyzes the present situation of the violent law enforcement and the reasons for the emergence of the violent law enforcement, and puts forward the relevant countermeasures in view of the existing problems. In order to promote the progress and perfection of urban management law enforcement in China, the serious phenomenon of violent law enforcement is analyzed.
