行政吸纳市场:我国药品安全与公共卫生的治理困境——以非法疫苗案件为例

【摘要】：保障药品安全是现代政府的基本职责,也是社会治理创新的重要内容。围绕2016年非法经营疫苗系列案件,引入整体治理理论,分析其内在机理。不同于既有观点,本文认为疫苗安全问题不在于市场化,而恰恰是行政逻辑吸纳市场机制带来的单边治理。其中,分段监管"碎片化"行政体制与全链条风险结构性不匹配;生产环节过度竞争与流通领域行政垄断阻碍了疫苗产业基础提升;负责预防接种的疾控机构存在公益性与营利化的内生目标冲突。市场和行政的结构性张力使疫苗安全长期维持在大事不出、小事不断的低水平均衡,直至利益链条被偶然事件打破。要重构疫苗安全体系,必须行政的归行政,市场的归市场,从监管嵌入产业、政府激发社会等维度入手,走现代化治理之路。
[Abstract]:The guarantee of drug safety is the basic duty of modern government and the important content of social governance innovation. According to the series of cases of illegal vaccine management in 2016, this paper introduces the theory of overall governance and analyzes its internal mechanism. Different from the existing point of view, this paper argues that the vaccine safety problem is not market-oriented, but is the unilateral governance brought about by the administrative logic absorption market mechanism. Among them, the piecewise supervision "fragmentation" administrative system and the whole chain risk structure mismatch, the production link excessive competition and the circulation domain administrative monopoly hindered the vaccine industry foundation enhancement; There is an endogenetic conflict between the public welfare and the profit-making target in the disease prevention and control institution in charge of vaccination. The structural tension of market and administration keeps the vaccine safety in the event of the event for a long time, and the low level equilibrium of the little thing continuously, until the chain of benefits is broken by the accident.
