法治背景下城管人性化执法问题研究

【摘要】：人性化执法的核心思想是与社会主义法治理念的价值目标相吻合,与构建社会主义和谐社会的目标相一致的,更是其的重要基础和前提。作为现代理性的执法方式，人性化是执政为民理念在城管执法中的重要现实体现，更是其实现和谐社会的重要途径。人性化倍受社会多方重视，是了社会焦点热点，在环境杂,执行难并与群众工作生活紧密相连的城管执法作中，其作用尤其突出。人性化执法作为执法方式的深化与发展，也得到了行政执法部门的肯定，但是如何使人性化真正融入到城管执法过程中，则需要从立法理念、管理理念、执法者、相对人等多角度仔细探究。本文试图以城管工作的现实问题入手，分析问题的成因，结合自身对城管工作的现状的认知和多年的一线执法工作经历，探索如何有效发展城管人性化执法，与完善人性化执法的多方条件。论文第一部分解释了城管的职责，阐述了我国城管成立至今的发展历程，并对城管人性化执法作出了准确合理的定义。论文第二部分以社会主义法治理念的背景出发，结合构建和谐社会的要求，阐述人性化执法在城管执法活动中的重要性与必要性。论文第三部分结合现状，分析目前存在的现实问题，如法律法规的缺失、政府管理目标过高、执法者与执法相对人之间的暴力冲突，媒体舆论的片面报道，对这些问题进行深入的分析，，找出人性化执法不能有效推行的原因所在。论文第四部分提出了有效实现人性化执法的具体对策，包括立法理念的调整，法律法规的统一适用性，转变执法理念，打造过硬队伍，提倡社会多方共同参与监督等，为贯彻城管人性化执法奠定了基础。
[Abstract]:The core idea of humanized law enforcement is consistent with the value goal of the socialist concept of rule of law and the goal of building a harmonious socialist society, which is an important foundation and premise. As a modern rational way of law enforcement, humanization is an important realistic embodiment of the concept of ruling for the people in the law enforcement of urban management, and it is also an important way to achieve a harmonious society. Humanization is paid more and more attention by the society, which is the focus of the society. It plays an important role in the urban management law enforcement, which is difficult to carry out and is closely related to the work and life of the masses. The deepening and development of humanized law enforcement as a way of law enforcement has also been affirmed by the administrative law enforcement departments. However, how to truly integrate humanization into the process of urban management law enforcement needs to be carried out from the legislative concept, the management concept, the law enforcers. The relative person and so on many angle careful research. This paper attempts to start with the practical problems of urban management, analyze the causes of the problems, combine their own understanding of the current situation of urban management and years of law enforcement experience, explore how to effectively develop urban management humanized law enforcement. And consummates the humanized law enforcement various conditions. The first part of the paper explains the duties of urban management, expounds the development process of urban management in China since its establishment, and gives an accurate and reasonable definition of humanized law enforcement of urban management. In the second part, the importance and necessity of humanized law enforcement in the law enforcement activities of urban management are expounded based on the background of the concept of socialist rule of law and the requirements of building a harmonious society. The third part of the paper analyzes the existing problems, such as the lack of laws and regulations, the high goal of government management, the violent conflict between law enforcers and law enforcement counterpart, the one-sided report of media opinion. Deeply analyze these problems and find out the reason why humanized law enforcement can't be carried out effectively. The fourth part of the paper puts forward concrete countermeasures to effectively realize humanized law enforcement, including the adjustment of legislation idea, the unification and applicability of laws and regulations, the transformation of law enforcement idea, the building of excellent team, and the promotion of social supervision, and so on. For the implementation of urban management of humanized law enforcement laid the foundation.
