西安高速交警执法规范化研究

【摘要】：随着社会进步经济发展,西安市作为西北地区的龙头省会城市,本市登记注册的机动车数量已突破260万辆大关。为提升城市公共交通功能,以高效交通描绘西安市发展宏图,高速交警作为第一负责人所肩负的使命与责任尤为重要,尤其是基层一线交警的业务素质和执法水平,关系到每一位交通参与者的切身利益,对人民警察形象的褒贬,社会的和谐稳定,都会产生不可估量的影响。那么建造一支高效率、严执法、强能力的执法队伍尤为重要。本文首先分析了西安市交警支队高速大队大力推进执法规范化建设工作的成效,剖析了目前仍然存在诸多问题。执法和处罚未能有效分离、现场处罚自由裁量权的滥用、非现场执法无统一规范、交通协管员管理混乱、事故处理违规违法频繁发生及民警正当权益得不到有效的保障维护。学习国内外的先进理念,结合实际情况,健全完善法律保障体系,修改补充法律法规上的不足,加强维护民警权益上的法律支持;加强公安交警队伍建设,提高行业准入标准,完善在职培训制度;构建科学高效的监督管理机制,开展职业道德教育学习活动,法律法规及时更新及时应用,健全监督管理制度,加大违规违纪处罚力度,科技监管在执法规范化中广泛应用;营造交通管理良性大环境,通过“互联网+”手段大力宣传交通安全理念,与协作单位共同完善执法队伍建设,加强内部外部监督体系,建设建立评审制度。全面建设社会主义法制国家就是要事无巨细的践行法治管理工作,结合当前开展的加快政府职能转变,提升行政效能。对于公安机关交通管理部门而言,就是要握好手中交管执法权力这把双刃剑,以规范化为执法准则,为群众出行的便捷畅通,为社会经济的蓬勃发展奉献力量保驾护航。
[Abstract]:With the development of society and economy, Xi'an, as the capital city of northwest China, has exceeded 2.6 million registered motor vehicles. In order to enhance the function of urban public transport and to depict the development of Xi'an with high efficiency traffic, the mission and responsibility of the high-speed traffic police as the first person in charge are particularly important, especially the professional quality and law enforcement level of the traffic police at the grass-roots level. Related to the vital interests of each traffic participant, the people's image of the police, social harmony and stability, will have an incalculable impact. It is particularly important to build an efficient, rigorous and capable law enforcement team. This paper first analyzes the achievements of the high-speed brigade of Xi'an traffic police detachment in promoting the standardization of law enforcement, and analyzes the problems that still exist at present. Law enforcement and punishment can not be separated effectively, the abuse of discretion on the spot punishment, the off-site law enforcement has no unified standard, traffic warden management confusion, accident handling illegal frequent occurrence and police legitimate rights and interests can not be effectively guaranteed and maintained. Learn the advanced concepts at home and abroad, combine with the actual situation, improve the legal protection system, modify the deficiencies in supplementary laws and regulations, and strengthen the legal support for the protection of the rights and interests of the police; Strengthen the construction of public security traffic police team, improve the industry access standards, improve the on-the-job training system; Constructing scientific and efficient supervision and management mechanism, carrying out professional ethics education and learning activities, timely updating and applying laws and regulations, perfecting supervision and management system, increasing the intensity of punishment for violation of discipline and discipline, and widely applying scientific and technological supervision in the standardization of law enforcement; To build a benign environment for traffic management, to propagate the concept of traffic safety through the means of "Internet", to improve the construction of law enforcement team together with cooperating units, to strengthen the internal and external supervision system, and to build up the evaluation system. To build a socialist country with legal system in an all-round way is to carry out the management of the rule of law in great detail, to accelerate the transformation of government functions and to enhance the administrative efficiency. For the traffic management department of the public security organ, it is necessary to grasp the double-edged sword of the law enforcement power in hand, take standardization as the criterion of law enforcement, ensure the convenience and unimpeded travel of the masses, and provide protection for the vigorous development of social economy.
