“囚徒困境”理论与我国食品质量安全的法律探析

【摘要】：在我国,食品质量安全问题是永恒的社会焦点,因为它涉及与食品相关的诸多利益主体,涉及食品的生产经营、消费、监管等领域和立法、执法、监管、司法等活动。"囚徒困境"博弈论是现代西方经济学一个经典学说,将其运用到我国食品质量安全问题的分析和研究,结合我国相关法律法规和制度体系,可以探索出各个"理性人"相互博弈所采取的"最佳选择"。只有建立严厉的惩罚机制、问责追责机制,建立多元化的奖励机制和大力推进公益诉讼,才能在我国营造一个合法且合理的食品质量安全环境。
[Abstract]:In China, the issue of food quality and safety is the eternal social focus because it involves many stakeholders related to food, the production and operation of food, consumption, supervision and other fields and activities such as legislation, law enforcement, supervision, and justice. " The "Prisoner's Dilemma" game theory is a classic theory of modern western economics, which is applied to the analysis and research of food quality and safety in China, combined with the relevant laws, regulations and system of our country. We can explore the "best choice" that each rational person adopts in the game. Only by establishing severe punishment mechanism, accountability and accountability mechanism, establishing diversified reward mechanism and vigorously promoting public interest litigation, can we create a legal and reasonable food quality and safety environment in our country.
