食品消费者知情权法律保护研究

【摘要】:近年来,我国出现了严重危害公众身体健康的食品安全问题,究其原因,很重要的一点在于消费者对于自己消费的产品并不能全面的了解。对症下药才能够保证疗效,所以,加强消费者对其所消费食品的认知,将法律规定的食品消费者知情权的落到实处可以在很大程度上解决这一问题。然而,从近几年的司法实践来看,食品消费者知情权遭到侵害的情况有进一步恶化的趋势,造成这种恶化趋势的原因是多方面的。一方面随着现代科技的迅猛发展和食品种类的多样化,有关食品的各种信息不仅繁多而且更新速度快。食品消费者对信息的接受能力已经难以跟上信息变化的速度,在受到侵害时往往也不知道如何保护自己的合法权益。另一方面,一些不良的食品经营者为了增加产品的竞争力故意提供各种虚假的信息误导甚至欺诈食品消费者,使消费者失去了重要的信息来源。除此之外,政府披露食品信息的体制不顺、食品安全信息发布渠道随意也是使食品消费者知情权受到侵害的重要原因。历史的经验告诉我们:保护食品消费者知情权对提高食品安全水平,保障食品消费者的合法权益有重大意义,因此,,要不断的完善我国食品消费者知情权法律保护制度来解决我国日益严重的食品问题。 本文立意以食品消费者为本位,对我国食品消费者知情权法律制度进行分析,揭示我国现有制度的缺陷,并在结合外国成功经验的基础之上,为完善食品消费者知情权保护的法律制度提出有针对性的意见。 本文主要分为以下几个部分:第一部分为引言,主要包含论文的写作目的和意义、国内外文献研究现状。第二部分结合三鹿奶粉案,引出食品消费者知情权的概念、原因以及实现食品消费者知情权的价值。第三部分主要通过分析国内外食品消费者知情权的法律保护制度,来探析我国食品消费者知情权存在的问题。第四部分从食品经营者政府机关及食品消费者的角度提出了完善我国食品消费者知情权的可行对策。
[Abstract]:In recent years, our country has appeared the food safety problem which seriously endangers the public health. The reason is that the consumers can not fully understand the products they consume. Therefore, to strengthen consumers' understanding of the food they consume and to implement the right to know about the food consumers stipulated by law can solve this problem to a great extent. However, judging from the judicial practice in recent years, the situation that food consumers' right to know has been violated has a trend of further deterioration, which is caused by many reasons. On the one hand, with the rapid development of modern science and technology and the diversification of food types, all kinds of information about food are not only various but also quickly updated. The ability of food consumers to accept information has been difficult to keep up with the speed of information change, and they often do not know how to protect their legitimate rights and interests when they are infringed. On the other hand, some bad food operators deliberately provide all kinds of false information to mislead or even defraud food consumers in order to increase the competitiveness of their products, thus depriving consumers of important information sources. In addition, the system of food information disclosure by the government is not good, and the food safety information release channels are also an important reason why food consumers' right to know is infringed. Historical experience tells us that it is of great significance to protect the right to know of food consumers to improve the level of food safety and to protect the legitimate rights and interests of food consumers. It is necessary to improve the legal protection system of food consumers' right to know to solve our country's increasingly serious food problems. Based on the idea of food consumers, this paper analyzes the legal system of the right to know of food consumers in China, reveals the defects of the existing system in China, and combines the successful experience of foreign countries. In order to improve the food consumer right to know the protection of the legal system put forward targeted advice. This paper is divided into the following parts: the first part is the introduction, including the purpose and significance of the paper, the status of literature research at home and abroad. The second part introduces the concept of food consumers' right to know and the value of realizing food consumers' right to know. The third part analyzes the existing problems of food consumers' right to know by analyzing the legal protection system of food consumers' right to know at home and abroad. The fourth part from the food operator? From the angle of government agencies and food consumers, the feasible countermeasures to perfect the right to know of food consumers in China are put forward.
