论我国患者权利的立法保护

【摘要】：对患者权利的立法保护,有利于尊重和保障人权、和谐医患关系、加强卫生法制建设。但我国患者权利立法保护不容乐观,存在专项法律缺失、现有法律规范层次较低、患者权利保护种类不足、患者权利救济途径不畅等问题。为充分保障患者权益,我国有必要制定《患者权利保护法》,明确患者的基本权利和义务,规范患者权利救济途径。
[Abstract]:The legislative protection of patients' rights is conducive to respecting and protecting human rights, harmonious doctor-patient relationship and strengthening the construction of health legal system. However, the legislative protection of patients' rights in our country is not optimistic, there are some problems, such as the lack of special laws, the low level of existing legal norms, the lack of types of patients' rights protection, the lack of relief ways for patients' rights, and so on. In order to fully protect the rights and interests of patients, it is necessary for our country to formulate patient Rights Protection Law, clarify patients' basic rights and obligations, and standardize the ways of patients' right relief.
