我国食品安全法律监管体系实效研究

【摘要】：“民以食为天”，在备受瞩目的2014年两会上，如何守护“舌尖上的安全”成为热点话题，备受关注。“地沟油、苏丹红、三聚氰胺、瘦肉精”等重大食品安全事件的阴影还笼罩着很多人，今年3·15又曝光了面包新语使用过期面粉、澳妙可奶粉保质期被篡改等重大食品安全问题，而想到接踵而至的未知的食品安全问题令我们不寒而栗。食品安全事件已经对中国社会和谐、经济发展以及政治稳定造成了多方面影响。侵害了人民群众的生命权和健康权，严重的扰乱了市场经济秩序，不仅仅是现届“两会”，食品安全已经连续成为历届“两会”的热点话题，这就看出我国对食品安全问题急需解决的迫切性。食品是人类得以生存的基本保障，食品安全问题自然成为各国重点保护的对象。在我国，食品安全问题不容乐观，形成原因多样、待于解决的问题复杂、解决机制不健全以及与国际先进管理制度的脱轨都成为我国食品安全的问题所在。 文章从食品安全的法理基础出发，深入的分析了我国食品安全对我国人民群众和国家的重要性，其主要涉及了人民群众的生命权和健康权两项基本人权，食品安全问题是构建法治国家、保障国家经济增长以及社会和谐发展的阻碍因素。食品安全问题的产生是我国食品安全监管法律体系不健全，监管存在严重问题所导致的。所以，文章分析了我国食品安全的现状，以及食品安全监管存在的问题与发生问题的原因，再结合国外发达国家与国际组织的先进监管制度作为借鉴经验，对我国食品安全监管体系提出了健全的构想，完善食品安全监管法律体系、建立集中的监管模式、明确食品安全责任制度、提高食品安全检测技术以及对外部环境和诚信体系的构建。食品安全问题刻不容缓，且时刻危害着人民群众的生命健康，损害着人们群众的权利。所以，我国应跟上市场全球化的速度，尽快对现有的《食品安全法》进行删减、补充和修订，，完善我国的食品安全法律监管体系构建。
[Abstract]:How to protect "safety on the tip of the tongue" has become a hot topic and has attracted much attention in the high-profile 2014 sessions. The shadow of major food safety incidents such as "gutter oil, Sudan red, melamine, lean meatloin" and other major food safety incidents still enveloped many people. This year, 3 / 15 also exposed the use of expired flour in the new language of bread and bread. Australian milk powder shelf life has been tampered with such major food safety issues, and the thought of the ensuing unknown food safety issues made us shudder. Food safety incidents have affected social harmony, economic development and political stability in China in many ways. It has infringed on the people's right to life and health, seriously disturbed the order of the market economy, not only the current "two sessions", but food security has become a hot topic of successive "two sessions." This sees our country to the food safety problem urgently needs to solve the urgency. Food is the basic guarantee of human survival, food safety has naturally become the focus of protection. In our country, the food safety problem is not optimistic, the forming reason is various, the problem to be solved is complex, the solution mechanism is not perfect, and the derailment with the international advanced management system all become the food safety problem of our country. Based on the legal basis of food safety, this paper deeply analyzes the importance of food safety to the masses of our country and the country, which mainly involves the two basic human rights of the people's right to life and the right to health. Food safety is an obstacle to the construction of a country ruled by law, the guarantee of national economic growth and the harmonious development of society. The problem of food safety is caused by the imperfect legal system of food safety supervision and the existence of serious problems in the supervision of food safety. Therefore, the article analyzes the current situation of food safety in China, as well as the existing problems and causes of food safety supervision, and combines the advanced regulatory systems of developed countries and international organizations as the reference experience. This paper puts forward a sound conception to the food safety supervision system of our country, consummates the food safety supervision legal system, establishes the centralized supervision mode, and clarifies the food safety responsibility system. Improve food safety detection technology and the construction of external environment and integrity system. The problem of food safety is urgent, and it endangers the life and health of the people and the rights of the people. Therefore, our country should keep pace with the speed of market globalization, delete, supplement and revise the existing Food Safety Law as soon as possible, and perfect the construction of our country's food safety legal supervision system.
