辅警辅助执法的法律问题研究

【摘要】：辅警在辅助执法时的违法犯罪事件频频发生,在社会上引起了广泛的非议,而问题却一直没有得到有效的解决。目前我国辅警在辅助执法过程中引发的问题非常的多,学术界也对这些问题给予了研究和讨论,不同的学者提出了不同的解决办法。尽管辅警在辅助执法时造成了很多的问题,也污损了整个辅警队伍的纯洁性和应有的形象;但不可否认,辅警辅助执法不仅缓解了我国现阶段因警力配置不足而带来的社会治安压力;而且极大地节约了公安机关的行政成本;同时也合理的整合和利用了各种有效的资源,避免造成资源的浪费。既然辅警作为一种维护社会治安稳定的力量发挥了重要的作用,那么辅警的存在则是必要的。从辅警在维护我国社会治安的广泛而深入的参与度来看,表明我国已经进入了警务多元化的时代,因而将辅警队伍取缔是不可行的。如果辅警的存在有其必要性,那么困扰我们的问题则在于如何管理这只队伍以及解决辅警辅助执法时存在的各种问题,并将辅警纳入规范化、制度化、法治化的轨道。首先,本文通过对我国辅警辅助执法的基本理论和现状进行分析和研究,对我国辅警队伍做一个全面的梳理并深入发掘辅警在辅助执法时存在的问题,比如越权执法,执法不当以及违法犯罪等。其次,对辅警制度比较完备的国家的辅警制度进行研究,比如英国、美国和法国。对它们的辅警制度以及管理运行进行分析,从而学习并借鉴它们的有益经验,用以完善我国的辅警制度。最后,对完善我国辅警辅助执法进行思考并提出相关的对策。从立法的完善,招录和管理制度的健全,辅警辅助执法时程序的规范以及法律责任承担和监督的强化等方面探索有效的辅警辅助执法时存在的问题的解决方法。总之,希望未来我国辅警队伍能够被培养成为一支可靠的力量,高效的履行其职责,为我国的社会治安管理尽应有之力。
[Abstract]:Auxiliary police in the auxiliary law enforcement of illegal and criminal incidents occurred frequently, caused widespread criticism in the society, but the problem has not been effectively resolved. At present, there are many problems caused by auxiliary police in the process of auxiliary law enforcement in our country. The academic circles have also studied and discussed these problems, and different scholars have put forward different solutions. Although auxiliary police in auxiliary law enforcement caused a lot of problems, but also tainted the integrity and image of the entire auxiliary police force; However, it is undeniable that auxiliary police not only alleviates the pressure of public security brought about by insufficient allocation of police force, but also saves the administrative cost of public security organs greatly. At the same time, reasonable integration and use of all kinds of effective resources, to avoid waste of resources. Since Auxiliary Police plays an important role as a force to maintain social order and stability, the existence of Auxiliary Police is necessary. From the extensive and deep participation of auxiliary police in maintaining public order in our country, it shows that our country has entered the era of police affairs diversification, so it is not feasible to ban the auxiliary police force. If the existence of Auxiliary Police has its necessity, the problem that puzzles us lies in how to manage this team and how to solve all kinds of problems when Auxiliary Police assist Law Enforcement, and bring Auxiliary Police into the orbit of standardization, institutionalization and rule by law. First of all, through the analysis and research on the basic theory and current situation of auxiliary police law enforcement in our country, this paper makes a comprehensive combing of the auxiliary police force in our country and deeply explores the problems existing in the auxiliary police law enforcement, such as ultra vires law enforcement. Improper enforcement of the law and illegal crimes, etc. Secondly, the Auxiliary Police system is studied in countries with perfect Auxiliary Police system, such as Britain, the United States and France. This paper analyzes their auxiliary police system and their management operation, so as to learn and draw lessons from their beneficial experience in order to perfect the auxiliary police system in our country. Finally, to perfect our country auxiliary police assistant law enforcement carries on the ponder and puts forward the related countermeasure. From the aspects of the perfection of legislation, the perfection of recruitment and management system, the standardization of procedure when auxiliary police enforce the law, and the strengthening of legal responsibility and supervision, this paper explores the solutions to the problems existing in the auxiliary law enforcement of auxiliary police. In a word, we hope that in the future, our auxiliary police team can be trained into a reliable force, efficiently perform its duties, and contribute to the management of public security in our country.
