美国、欧盟、日本食品安全突发事件法律应对机制比较研究

【摘要】：食品安全问题事关社会稳定及民众的生命健康,防止食品安全突发事件的发生是各国食品安全规制的主要内容之一。基于此,本文以美国、欧盟、日本3个国家和地区为基础,分析了其各自的食品安全立法体系及应对食品安全突发事件的法律运作机制。在此基础上,比较了3个国家和地区在应对食品安全突发事件法律机制上的异同。最后从中国情况看,需要从完善食品安全法律体系、注重事先预防及风险评估机制、建构食品安全信息公开系统以及注重建设事后的责任追究机制等几个方面来完善中国的食品安全突发事件应对机制。
[Abstract]:The problem of food safety is related to the social stability and the life and health of the people. To prevent the occurrence of food safety emergencies is one of the main contents of food safety regulation in various countries. Based on this, this paper analyzes their respective food safety legislation system and the legal operation mechanism to deal with food safety emergencies based on the three countries and regions: the United States, the European Union and Japan. On this basis, the similarities and differences of three countries and regions in the legal mechanism of food safety emergencies are compared. Finally, from the point of view of the situation in China, it is necessary to improve the food safety legal system and pay attention to the mechanism of pre-prevention and risk assessment. In order to perfect the food safety emergency response mechanism in China, the food safety information publicity system and the responsibility investigation mechanism should be established.
