人体器官移植中自我决定权的行使边界

【摘要】：正随着医学技术的进步,在医疗领域,器官移植现象逐渐增多,相应地,自我决定权在人体器官移植过程中的行使应当得到充分尊重。但权利的放任容易导致权利滥用,应对自我决定权在人体器官移植中的行使设立,诸如程度、范围、承诺的撤回以及主体等多方面进行限制,以保证权利行使符合法律规定,遵循公共秩序与善良风俗。一、人体器官移植中的自我决定权自我决定权又称为自己决定的自由,是指公民个人有权按照自己的意志自由支配自己的权利,亦
[Abstract]:With the development of medical technology, the phenomenon of organ transplantation is increasing in the medical field. Accordingly, the exercise of self-decision in the process of human organ transplantation should be fully respected. However, the laissez-faire of rights can lead to abuse of rights, so the exercise of self-decision right in human organ transplantation should be established, such as degree, scope, withdrawal of promise and subject, so as to ensure that the exercise of rights is in accordance with the provisions of the law. Follow public order and good customs. First, the right of self-determination in human organ transplantation is also referred to as the freedom of decision, which means that individual citizens have the right to freely dispose of their own rights in accordance with their own will.
