武警角色的法理分析

【摘要】：发达国家和地区的宪兵、军事警察、内务部队等是与我国武警相类似的武装力量,一般具有现役军人、行政警察、灾难救助者、司法警察、军事警察、军法警察等六种法律角色。而我国武警因其编制多元、体系复杂、指挥重叠、任务多样等因素,其法律角色并不易被准确界定,理应通过加强立法和修法补充所欠缺的司法、军事和军法警察三种角色,出台详细、完备的配套法规和政策以进一步明确现役军人和行政警察角色的意涵,积极推进武警角色的重构,逐渐限制直至废弃其和平建设者的角色,但要重点型塑其专业灾害救援者的角色。
[Abstract]:The gendarmerie, military police, and internal affairs forces of developed countries and regions are armed forces similar to the armed police of our country. They generally have active military personnel, administrative police, disaster rescuers, judicial police, military police, etc. There are six kinds of legal roles, such as military law police and so on. However, due to its diverse structure, complex system, overlapping command, diverse tasks, and other factors, the legal role of our armed police is not easy to be accurately defined. It should be supplemented by strengthening the legislation and amending the law to supplement the three lacking roles of the judiciary, military and military law police. Introducing detailed and complete supporting laws and policies to further clarify the meaning of the role of active servicemen and administrative police, actively promoting the reconstruction of the role of the armed police, gradually restricting and even abandoning its role as a peacebuilder, But to focus on the shape of its professional disaster relief role.
