中哈矿产资源权属取得及变更制度比较研究

【摘要】：中国与哈萨克斯坦矿产资源立法的差异性是两国矿业合作的法律壁垒与制度阻却,而矿产资源权属取得及变更的法律制度设计则同为两国矿业法制的核心与基础。通过对两国矿产资源法律权属的对比研究,可见两国在矿产资源权属取得制度、矿产资源担保物权制度及矿产资源权属变更和权利终止制度三个主要层面上异同并存,且哈萨克斯坦法律的相关规定对弥补我国矿业法制的缺漏与不足亦有一定的借鉴意义。
[Abstract]:The difference of mineral resources legislation between China and Kazakhstan is the legal barrier and institutional obstacle of mining cooperation between China and Kazakhstan, while the design of legal system of acquiring and changing the ownership of mineral resources is the core and foundation of the mining legal system of the two countries. Through the comparative study of the legal ownership of mineral resources between the two countries, it can be seen that the two countries coexist on three main levels: the acquisition system of mineral resources tenure, the system of security interest in mineral resources, the alteration of ownership of mineral resources and the system of termination of rights. The relevant provisions of Kazakstan law can also be used for reference to remedy the deficiencies and deficiencies of mining legal system in our country.
