浅析劳动合同中试用期条款

【摘要】：我国宪法明确规定,中华人民共和国公民有劳动的权利和义务。在社会生活中,我们通过自己的劳动来维持个人生活,满足精神需求。然而,随着就业形势的日益严峻,劳动者对于他们赖以维持生计的工作机会愈发珍惜,致使他们在权益遭受侵犯时不敢发声,于是在用人单位面前处于更加弱势的地位。这种情况在试用期尤为明显,用人单位往往通过约定长时间的试用期、偏低的试用期工资等手段来压榨刚进入工作岗位的劳动者,以此来降低用工成本。因此,对于试用期内劳动者权利保护问题需要引起社会各界的广泛关注。
[Abstract]:Our Constitution clearly stipulates that citizens of the people's Republic of China have the right and duty to work. In social life, we through their own labor to maintain personal life, meet spiritual needs. However, with the increasingly severe employment situation, workers increasingly cherish their livelihood work opportunities, so they do not dare to speak out when their rights and interests are infringed, so they are in a more vulnerable position in front of employers. This kind of situation is especially obvious in probation period, unit of choose and employ persons often through the appointment of long trial period, low probation period wages and other means to squeeze the workers who just entered the job, so as to reduce the cost of employment. Therefore, the protection of workers' rights during probation period needs wide attention from all walks of life.
