各省食品安全有奖举报激励制度比较研究

【摘要】：食品安全是民生的基础,食品安全关乎国家的稳定,关乎社会公共利益,关乎人们的生活健康,轻视食品安全问题,就相当于轻视或否定了宝贵的生命本身。食品安全问题日益引起人们的重视,食品安全有奖举报激励制度应运而生。食品安全有奖举报激励制度包括物质奖励制度、精神奖励制度、举报人保密制度、程序制度及其他制度部分。一是物质奖励制度,包括一般性奖励制度和重奖奖励制度,各省市对举报人奖励的金额普遍较低;二是精神奖励制度即荣誉制度。全国范围内关于食品安全有奖举报激励制度中精神奖励制度的规定非常少,在现有的食品安全举报奖励制度中物质奖励和精神奖励不能同时享有。三是举报人保密制度,包括对举报人身份等隐私信息进行保护和对举报人的人身安全进行保护。四是奖励程序制度。奖励程序包含奖励申请、奖励审批、通知和奖励发放,这些过程所耗时间很长,涉及到各级食品安全监管部门以及各级财政部门等,十分复杂。面对实施过程中出现的问题,各省市需要从奖金制度、荣誉制度、保密制度、程序制度等其他制度上进行完善。提高物质奖励的金额,增加荣誉制度,增强举报者的社会荣誉感,增加隐名举报和密码举报的方式,加强对举报人信息保护和人身安全的保护。加大对泄密者的打击惩处力度,充分保障举报人的安全。在奖励程序上,简化程序,加强各个食品安全监管部门及相关部门的合作联系,提高奖励效率,使得举报人能够及时获得奖励,激励知情者参与监督举报的热情。
[Abstract]:Food safety is the foundation of people's livelihood. Food safety is related to the stability of the country, the public interest, the life and health of people, and despising food safety is tantamount to belittling or denying the precious life itself. People pay more and more attention to the problem of food safety, and the incentive system of food safety report arises at the historic moment. The incentive system includes material reward system, spirit reward system, whistleblower secrecy system, procedure system and other systems. One is the material reward system, including the general reward system and the heavy award system, the amount of reward to the whistleblower is generally low, the second is the spiritual reward system, that is, the honor system. There are very few regulations on the spirit reward system in the food safety reward reporting system, and the material reward and the spiritual reward can not be enjoyed simultaneously in the existing food safety report reward system. Third, whistleblower secrecy system, including the identity of whistleblower and other privacy information protection and whistleblower personal security protection. Fourth, reward procedure system. The reward procedure includes application for reward, examination and approval of reward, notification and award. These processes take a long time and involve food safety supervision department at all levels and financial department at all levels, and are very complicated. Faced with the problems in the process of implementation, provinces and cities need to improve the bonus system, honor system, secrecy system, procedural system and other systems. We should increase the amount of material rewards, increase the honor system, enhance the social honor of whistleblowers, increase the ways of anonymous reporting and password reporting, and strengthen the protection of whistle-blowers' information and personal safety. Step up the crackdown on whistleblowers to ensure the safety of whistleblowers. In the reward procedure, we should simplify the procedure, strengthen the cooperation between the food safety supervision department and the relevant departments, improve the reward efficiency, make the whistleblower get the reward in time, and encourage the informant to participate in the supervision and report of the enthusiasm.
