权力清单制度:城管执法合法性困境的制度性回应

【摘要】：权力清单制度作为规范权力清单推行各阶段的法律法规,价值在于保证权力清单的依法推行.从而达到规范行政权的行使。当前城管执法面临着行政主体资格不明等合法性困境,权力清单制度是对城管执法合法性困境的制度性回应。权力清单本身也存在合法性的困境,国家层面应出台明确城管执法权力清单的法律法规,地方层面应出台规定城管执法权力清单的内容和程序的地方性法规、规章,同时保证城管执法权力清单各阶段依法推进。
