我国留学中介机构的法律监管研究

【摘要】：加入WT0之后,我国的留学事业有了更加广阔的平台,催生了新的“留学潮”出国留学已经成为新的流行趋势,每年有大批的学子为了寻求更好的求学机会,漂洋过海,到异国他乡求学。这其中留学中介起到了不小的作用,不仅提供专业的咨询还提供便利的服务。在留学市场炙手可热的同时,留学中介机构也成为这其中最佳的受益者。2013年我国出国留学人数已经超过45万人,留学中介机构的市场份额甚至高达90亿元,仍将保持着15%-20%的增长率。但是在火爆的留学市场中,留学中介机构的投诉却是最多的,市场满意度也是最低的。虽然我们国家已经加大了对留学中介机构的监管,出台了相关的法律法规,甚至加大了对留学中介机构的留学预警,并在教育涉外监管信息网上公布留学信息。但是在对留学中介机构进行监管的过程中还是存在很多问题尚未解决。因而本文通过研究留学中介机构,对留学中介机构的监管现状,存在的问题进行分析,提出了完善我国留学中介机构法律监管的建议。本文共分四个部分： 第一部分是留学中介机构的概述。通过对留学中介机构的界定,以及对留学中介机构法律地位和特征的阐释,进而对留学中介机构进行法律监管的必要性进行分析。 第二部分是我国留学中介机构的监管现状。该部分主要对我国留学中介机构监管的立法现状,留学中介监管机构的设置,以及留学中介机构监管取得的成效进行阐述。 第三部分是留学中介机构监管中存在的问题。主要从留学中介机构监管的法律法规,监管主体,资质审查,打击力度这四个方面阐述留学中介机构存在的问题。 第四部分是完善我国留学中介机构法律监管的建议。本部分是在综合前几部分的内容基础之上,针对我国留学中介机构存在的问题,结合我国实际提出了完善我国留学中介机构法律监管的建议。
[Abstract]:After China's entry into the WT0, the cause of studying abroad in our country has a broader platform, which has given birth to a new "tide of studying abroad" and has become a new popular trend. Every year, a large number of students cross the sea in order to seek better opportunities for study. To study in a foreign country. The agency plays a significant role, not only providing professional advice, but also providing convenient services. While the study abroad market is hot, the study abroad agencies have also become the best beneficiaries. In 2013, the number of people studying abroad in China has exceeded 450000, and the market share of the study abroad agencies is even as high as 9 billion yuan. Will still maintain a growth rate of 15-20%. But in the burgeoning market of studying abroad, the complaint of the agency is the most, and the satisfaction of the market is also the lowest. Although our country has strengthened the supervision to the study abroad intermediary organization, has issued the related laws and regulations, even increased the study abroad early warning to the study abroad intermediary organization, and announced the study abroad information on the educational foreign affairs supervision information network. However, there are still many problems to be solved in the process of supervising the agencies. Therefore, this paper analyzes the present situation and existing problems of the supervision of the study abroad intermediary, and puts forward some suggestions to perfect the legal supervision of the study abroad intermediary in our country. This paper is divided into four parts: the first part is an overview of the agency. Through the definition of the agency of studying abroad, and the interpretation of the legal status and characteristics of the agency, the necessity of legal supervision of the agency is analyzed. The second part is the present situation of the supervision of the agency of studying abroad in our country. This part mainly expounds the present situation of the legislation on the supervision of the study abroad intermediary in our country, the establishment of the supervision organization of the study abroad agency, and the effect of the supervision of the study abroad agency. The third part is the problems existing in the supervision of the agency. This paper expounds the problems existing in the agency of studying abroad from four aspects: the law and regulations, the subject of supervision, the examination of qualification, and the intensity of crackdown. The fourth part is to perfect our country study abroad intermediary organization legal supervision suggestion. This part is on the basis of synthesizing the contents of the first few parts, aiming at the problems existing in the agencies of studying abroad in our country, and combining with the reality of our country, it puts forward some suggestions to perfect the legal supervision of the agencies of studying abroad in our country.
