保障农民权益:农村土地政策演进特征与启示

【摘要】：文章通过还原土地改革时期以来不同阶段典型的法律、政策与法规,详细梳理我国农村土地政策的演进历程,揭示政策变迁过程中深层次的规律。研究结果表明,政策演进过程中实质是农民土地权益交叉实现和不断增强的过程。在更大程度上赋予农民更清晰、更确定的土地权能是我国未来农村土地制度改革的方向,因此,当前在坚持土地承包责任制度的基础上,可尝试构建以"农民家庭"为主体的土地产权制度,以期最大限度保障农民土地权益。
[Abstract]:By restoring the typical laws, policies and regulations in different stages since the period of land reform, this paper makes a detailed analysis of the evolution of rural land policies in China, and reveals the deep-seated laws in the process of policy changes. The results show that the essence of the policy evolution is the process of realizing and increasing the farmers' land rights and interests. To a greater extent, giving farmers a clearer and more definite land power is the direction of the future rural land system reform in China. Therefore, on the basis of adhering to the system of land contracting responsibility, We can try to construct the land property right system with "peasant family" as the main body, in order to protect the peasants' land rights and interests to the maximum extent.
