“三权分置”制度下农村土地流转失约风险的防范机制研究

【摘要】："三权分置"制度改革背景下,全国农村土地流转全面推开,新型经营主体纷纷进入。投资农业领域经营的工商企业因经营不善而拖欠土地流转租金,甚至违反土地流转合同而"跑路"、"毁约弃耕"等失约现象常有发生,这与工商资本"逐利心切"、粮食市场"价格波动"、基层政府"行为失范"、法律法规"供应不足"等存在较大关联。土地流转失约使农户无法获得流转租金甚至要承担复耕成本,严重挫伤了农户放活经营权的积极性。为保障农户土地流转利益,提高土地流转履约率,防止"毁约弃耕"失约风险发生,政府应强化土地流转合约约束力,推进农业供给侧结构性改革,加强土地流转监管和服务,敦促工商资本履行社会责任,建立土地流转履约保险机制,创设完善土地流转法律制度。
[Abstract]:In the background of the reform of the "three-power split" system, the rural land circulation in the whole country is pushed open, and the new type of operating main body has entered. The business enterprises operating in the area of investment agriculture are in arrears with the rent of land circulation due to poor management, even in violation of the land circulation contract, and even the loss of the land transfer contract. The loss of land circulation is related to the "one-by-one", the grain market price fluctuation ", the basic government's behavior anomie, and the supply of laws and regulations". In order to guarantee the farmers' land circulation benefit, improve the land circulation performance rate and prevent the damage of the land circulation, the government should strengthen the land circulation contract binding force, advance the structural reform of the agricultural supply side, strengthen the land circulation supervision and service, urge the industrial and commercial capital to carry out the social responsibility, establish the land transfer performance insurance mechanism, and create a legal system to improve the land circulation.
