国家监察体制改革的实践考察和理论省思

【摘要】：现行监察体制不适应现实需要亟待改革。十八大以来党领导的政治法治实践及获得的民意民众基础为其改革提供了成熟的现实条件。指导试点改革的两个纲领性文件亟待完善,确定机构名称、监察职责、监察职权、监察对象、监察程序等是国家监察体制改革的核心任务。国家监察体制改革应区分为试点改革、全面铺开和宪法确认等三个阶段并分别提供法律保障。从本质上看,国家监察体制改革是我党领导的全新政治实践,最终提出了践行分权原则的中国样本。
[Abstract]:The current supervisory system does not adapt to the reality of the need for urgent reform. Since the 18th CPC National Congress, the practice of political rule of law led by the Party and the popular basis of public opinion have provided mature and realistic conditions for its reform. The two programmatic documents guiding the pilot reform need to be perfected. It is the core task of the reform of the national supervisory system to determine the name of the organization, supervise the responsibility, supervise the power, the object of supervision, the supervisory procedure, and so on. The reform of state supervision system should be divided into three stages: pilot reform, comprehensive spread and constitutional confirmation, and provide legal guarantee respectively. In essence, the reform of state supervision system is a brand-new political practice led by our Party, and finally puts forward a sample of China to practice the principle of separation of powers.
