论我国突发事件中行政补偿制度立法的完善

【摘要】:2003年的“非典”暴露出了我国应急法制的缺失,2007年8月30日第十届全国人民代表大会常务委员会第二十九次会议通过了《中华人民共和国突发事件应对法》,这是中国第一部应对各类突发事件的综合性基本法律,其中凝聚了中国人民长期以来与自然灾害、事故灾害等突发性事件顽强搏斗摸索出的经验。该法对于在突发事件发生时,政府及其部门是否可以征用单位和个人的财产作了明确的规定,同时,关于被征用财产在使用完毕或者突发事件应急处置工作结束后该如何处理,以及对于被征用的财产在被征用或是征用后损毁、灭失的该如何处理,同样做出了明确的指示;遗憾的是该法中有关于行政补偿的规定比较笼统,只规定了被征用的财产被征用或是征用后损毁、灭失的应当给予补偿,至于怎么补偿,补偿多少,补偿的程序等等都没有规定。 《中华人民共和国宪法》为行政补偿制度提供了宪法依据,《突发事件应对法》《物权法》等丰富了补偿制度立法,但是目前我国的行政补偿制度补偿的原则不明确,标准不确定,范围过于狭窄,程序不完善,完善该制度需要明确补偿原则,确定补偿标准,扩大补偿范围,完善补偿程序,并从整体上构建一个合理公平的系统。
[Abstract]:The SARS of 2003 exposed the lack of emergency legal system in China, and on 30 August 2007, the 29th meeting of the standing Committee of the Tenth National people's Congress adopted the Law of the people's Republic of China on Emergency response. This is China's first comprehensive basic law to deal with all kinds of emergencies, which embodies the experience of the Chinese people in their long-standing struggle with sudden events such as natural disasters, accident disasters and so on. The Act makes clear provisions as to whether the Government and its departments may expropriate the property of units and individuals in the event of an emergency, and at the same time, on how to deal with the expropriated property after the use of the property has been completed or the emergency disposal of the emergency is completed. As well as the expropriated property in the requisition or after the damage, the loss of how to deal with, also made clear instructions; Unfortunately, there are more general provisions on administrative compensation in the Act, which only provide for expropriated property being expropriated or damaged after expropriation, the loss of which shall be compensated, as to how to compensate, and the amount of compensation, The procedures for compensation, etc., are not regulated. The Constitution of the people's Republic of China provides the constitutional basis for the administrative compensation system, and the Law on the response to Emergencies enriches the legislation of the compensation system, but at present the principle of compensation for the administrative compensation system in our country is not clear. The standard is uncertain, the scope is too narrow and the procedure is not perfect. It is necessary to make clear the compensation principle, determine the compensation standard, enlarge the compensation range, perfect the compensation procedure, and construct a reasonable and fair system as a whole.
