走出困境:网络淫秽色情之规制

【摘要】：互联网的快速发展加速了信息社会的实现,同时也导致网络淫秽色情信息的泛滥,不利于青少年健康成长。我们对网络淫秽色情的监管很被动,删除淫秽色情信息是没有用的,只有在服务器上进行封堵,才能真正有效及时控制。网络的原始结构并不适合管制的实施,但随着网络结构的精致化,将有利于网络规制。网络淫秽色情内容规制分为两种类型:分区管制和内容分级过滤。分区管制要求网络经营者采取措施阻隔青少年进入特定区域,内容分级过滤则赋予接收者阻断特定信息的权限。当前我国宜将淫秽色情信息进行界定,区分"淫秽""色情""低俗"的内涵,推动网络内容分级过滤制度的建设;同时,在法律上课予网站经营者在发布信息时采取隔绝措施的义务,在判断行为人所采取的某种隔绝措施是否足以构成法律上的免责事由时,必须考虑到当时的科技水平。
[Abstract]:The rapid development of the Internet accelerates the realization of the information society, but also leads to the proliferation of pornographic information on the Internet, which is not conducive to the healthy growth of young people. Our supervision of online obscene pornography is very passive, it is useless to delete obscene pornographic information, only by blocking it on the server, can we control it effectively and in time. The original structure of the network is not suitable for the implementation of regulation, but with the refinement of the network structure, it will be beneficial to the regulation of the network. There are two types of Internet pornographic content regulation: zoning control and content hierarchical filtering. Zoning control requires network operators to take measures to prevent young people from entering a specific area, and content hierarchical filtering gives the recipient the right to block specific information. At present, our country should define the obscene pornographic information, distinguish the connotation of "obscene", "pornographic" and "vulgar", and promote the construction of the hierarchical filtering system of network content; at the same time, the legal obligation of website operators to take isolation measures when publishing information must take into account the scientific and technological level at that time when judging whether a certain isolation measure taken by the perpetrator is sufficient to constitute the cause of legal exemption.
