上海自由贸易区知识产权保护忧思录

【摘要】：正中国(上海)自由贸易试验区是在特殊的国际和国内背景下设立的,其本质是一国在本国境内自主设立的,实施比国内其他区域更为优惠的经济贸易政策和更为便利的海关制度的区域,仅在关税意义下可视为"境内关外"。这一系列文章从不同的角度辨析FTZ与FTA的区别,明确上海自贸区的性质,奠定知识产权法及海关监管执法的基础,在此之上对国内外贸易新形势及自贸区中关键的综合执法、争端解决机制的创新及具体涉及贴牌加工贸易中的商标侵权、过境货物的知识产权保护、自贸区中的平行进口行为规制等知识产权保护问题进行探讨。在具体问题的探讨中
[Abstract]:The China (Shanghai) free trade experimental area was set up in a special international and domestic context, and its essence is that a country has established itself within its own territory. Regions that implement more preferential economic and trade policies and more convenient customs regimes than other regions in the country can only be regarded as "domestic and foreign customs" in the sense of tariffs. This series of articles distinguishes the difference between FTZ and FTA from different angles. To clarify the nature of the Shanghai Free Trade Zone, to lay the foundation for intellectual property Law and Customs Supervision and Enforcement, and on this basis, to deal with the new situation of domestic and foreign trade and the key comprehensive law enforcement in the Free Trade Zone, The innovation of dispute settlement mechanism and the protection of intellectual property rights, such as trademark infringement, intellectual property protection of goods in transit, parallel import behavior regulation in the free trade zone, etc. are discussed.
