【摘要】：慈善组织是慈善事业发展最重要的载体,我国慈善事业的蓬勃发展对慈善组织合理架构产生了强烈的内在需求。2016年9月1日《中华人民共和国慈善法》历时十余年正式出台,新法对慈善组织的认定以及新设作出了统一指引,为下一步慈善组织的合理架构做了重要铺垫。2017年3月15日通过的《中华人民共和国民法总则》一改原有的法人分类,将法人分为营利法人、非营利法人以及特别法人,也旨在加强对包括慈善组织在内的社会组织的引导和规范。然而,慈善组织法律架构错综复杂局面很难在短期内改变。确立一个主导型的慈善组织类型,并以此为基点构建我国慈善组织的新格局可以成为解决问题的一个路径。基于我国慈善组织的法律传统与现实、重要性及制度,基金会可以成为主导型慈善组织模式,其价值导向对新法之下慈善法律新秩序的建立和社会组织功能的发挥具有现实意义。
[Abstract]:Charity organization is the most important carrier of charity development. The vigorous development of philanthropy in China has produced a strong internal demand for the reasonable structure of charitable organizations. In September 1st 2016, the philanthropy Law of the people's Republic of China took more than 10 years to formally introduce. The new law provides a unified guide to the identification and establishment of charitable organizations. In March 15th 2017, the General principles of Civil Law of the people's Republic of China changed the original classification of legal persons and divided legal persons into profit-making legal persons. Non-profit legal persons, as well as special legal persons, are also aimed at strengthening the guidance and regulation of social organizations, including charitable organizations. It is difficult to change the legal framework of charitable organizations in the short term. And on this basis, the construction of a new pattern of charitable organizations in China can become a way to solve the problem. Based on the legal tradition and reality, importance and system of charity organizations in China. The foundation can become the leading charity organization mode, and its value orientation has practical significance for the establishment of the new law of charity law and the exertion of the function of social organization.
