【摘要】：内容全面、效力明显的广西金秀瑶族石牌习惯法的许多规范传承、保留到了当代社会。在当今的金秀地区,物权习惯法、借贷习惯法、交换习惯法、婚姻习惯法、分家析产习惯法、互助习惯法、公共事务习惯法、丧葬习惯法、纠纷解决习惯法等得到全面传承。民众广泛通过村规民约弘扬习惯法,发扬村老制度、"众节"习惯法、"做社"习惯法等的积极功能,并将金秀瑶族石牌制作为非物质文化遗产进行保护。金秀地方国家权力机关、司法机关、行政机关等国家机构依法通过各种方式对固有习惯法予以肯定和运用,表现出对习惯法的重视和尊重。我们应当尊重习惯法的客观存在,恰当处理现代法治建设中的习惯法,承继习惯法的理性规范,吸纳习惯法的良善内容,扬弃习惯法的恶法因素,使当代中国的法治建设具有坚实的本土基础。
[Abstract]:Guangxi Jinxiu Yao Yao customary law of many norms heritage, retained to the contemporary society. In today's Jinxiu area, real right customary law, borrowing customary law, exchange customary law. The customary law of marriage, the customary law of separation of property, the customary law of mutual aid, the customary law of public affairs, the customary law of funeral, the customary law of dispute resolution, etc. Carry forward the village old system, "public festival" customary law, "do society" customary law and other positive functions, and make Jinxiu Yao stone for the protection of intangible cultural heritage. Jinxiu local state power organs, judicial organs. State agencies such as administrative organs affirm and apply the inherent customary law in various ways according to law, showing the importance and respect for customary law. We should respect the objective existence of customary law. To properly deal with the customary law in the construction of modern rule of law, to inherit the rational norms of customary law, to absorb the good and good contents of customary law, to sublate the elements of evil law of customary law, and to make the construction of the rule of law in contemporary China have a solid local foundation.
