基于适度居住权保障的房地产政策研究

【摘要】:适度居住权保障从本质上来讲是一个公共管理问题,因为它涉及到的是大多数人的公共利益,因此在研究当中必然要运用到公共管理理论。从关系上来讲,适度居住权保障需要通过房地产政策来实现,可以说政策本身就是适度居住权保障的措施。而适度居住权保障则是房地产政策实施的一个重要的目的,当然房地产政策实施的目的是多刚面的,适度居住权保障只是其中的其中,这就是二者之间的关系。为了促进房地产业的健康发展,抑制房价过快上涨的问题,国家出台了一些列的房地产政策,以满足人民群众的住房需求。这些政策包括保障房建设、“限购政策”、新“国五条”、房地产供应结构管理等等。这些政策的对于稳定房价、保证房地产市场的健康发展,满足人民群众的住房需求起到了良好的作用,现有的房地产政策虽然能够在一定程度上满足公民的住房需求,但是离适度住房权保障还有很明显的距离,尤其是一些政策实施的效果不尽人意,甚至出现了房价越调越高的现象,严重影响到公民住房权的实现。本部分主要结合这些政策的内容,分析现有政策在适度居住权保障上的不足,并分析这些问题产生的主要原因。本文根据现有的研究资料,结合国务院提出的适度居住权保障的精神,,就如何改进现有政策中的不足,以实现适度居住权保障的目的,提出了针对性的对策建议,以期能够给政策的决策者和实施者提供一些帮助和启示。
[Abstract]:The right of moderate residence is essentially a public management problem, because it involves the public interests of most people, so it must be applied to the theory of public management in the study. The moderate residence right guarantee needs to be realized through the real estate policy. It can be said that the policy itself is the appropriate residence right safeguard measure, and the moderate residence right safeguard is an important purpose of the real estate policy implementation. Of course, the purpose of the implementation of real estate policy is more rigid, the moderate right of residence is only one of them, this is the relationship between the two. In order to promote the healthy development of the real estate industry, curb the rapid rise of housing prices. The State has introduced a number of real estate policies to meet the housing needs of the people. These policies include the indemnificatory apartment construction, the "purchase restriction policy" and the new "five articles of the country". These policies have played a good role in stabilizing housing prices, ensuring the healthy development of the real estate market and meeting the housing needs of the people. Although the existing real estate policy can meet the housing needs of citizens to a certain extent, but there is still a clear distance from the moderate housing right security, especially the implementation of some policies is unsatisfactory. Even the phenomenon of higher housing prices seriously affects the realization of citizens' housing rights. This part mainly combines the content of these policies to analyze the shortcomings of existing policies in the appropriate right of residence protection. And analyze the main causes of these problems. According to the existing research materials, combined with the State Council proposed the spirit of moderate residence right protection, on how to improve the existing policy deficiencies. In order to realize the goal of moderate residence right, this paper puts forward some countermeasures and suggestions in order to provide some help and enlightenment to the policy makers and implementers.
