食品行业协会在云南食品安全治理中的作用研究

【摘要】:当前中国社会,食品安全事故频发,食品安全危机重重,食品安全成为政府监管的一大难题和重点,是社会和经济问题,更是公共管理问题。目前,我国的食品安全监管模式,仍然是政府垄断型的,在主观的监管意愿和客观的监管能力上,一直都存在着无法完全克服的制度缺失和固有缺陷。相较于政府垄断型的他律约束而言,食品行业协会在信息获取、监管动力、监管成本、监管范围等很多方面,都具有不可替代的功能优势,可以有效弥补政府行政监管之不足。因此,在食品安全治理中,除了要加强行政监管的他律和经营者个体自律之外,还需要充分发挥食品行业协会的自律作用,即通过经营者内生的组织进行自我管理,加强行业内部监督,再加上行政监督和经营者个体的自律,“三架马车”共同形成更有力的约束力量。 但是,当前我国食品行业协会的发展面临许多障碍,食品行业协会自律监管的功能优势在政府垄断型的食品安全监管框架下,并没有得到有效发挥。本文以云南省的食品行业协会为例,运用治理理论、第三部门理论进行分析,阐明食品行业协会目前的现状和存在的问题,指出要使食品行业协会更好地参与食品安全治理,推进食品行业协会的自律监管,就需要树立食品安全“合作治理”的新理念,在外部环境上,要健全食品行业协会的法制基础,改革双重管理体制,提升食品行业协会在食品安全治理中的主体地位;在协会自身建设上,要完善自主治理结构,加强食品行业协会自身能力建设,提高食品行业协会的行业代表性,发挥食品行业协会在食品安全监管体制建设中的主体地位,充分发挥其自律监管的治理职能,在食品安全治理中发挥应有的功能作用。
[Abstract]:In the current Chinese society, food safety accidents occur frequently, and food safety is full of dangers. Food safety has become a major problem and focus of government supervision. It is also a social and economic problem and a matter of public administration. At present, the mode of food safety supervision in China, It is still monopolized by the government. There are always institutional defects and inherent defects which can not be completely overcome in subjective supervision will and objective supervision ability. Food industry associations have irreplaceable functional advantages in many aspects, such as information acquisition, regulatory motivation, regulatory costs, regulatory scope and so on, which can effectively make up for the deficiencies of government administrative supervision. Therefore, in food safety governance, In addition to strengthening the discipline of administrative supervision and the self-discipline of individual operators, it is also necessary to give full play to the self-discipline role of food industry associations, that is, to strengthen the internal supervision of the industry through the self-management of the operators' endogenous organizations. In addition, administrative supervision and self-discipline of operators, the "three carriages" together form a more powerful force of restraint. However, at present, the development of food industry associations in China is facing many obstacles. The functional advantages of self-regulation of food industry associations lie in the framework of government monopoly food safety supervision. This article takes the food industry association of Yunnan Province as an example, applies the governance theory and the third sector theory to analyze the current situation and existing problems of the food industry association. It is pointed out that in order to make food industry associations better participate in food safety governance and promote self-regulation of food industry associations, it is necessary to set up a new concept of "cooperative governance" of food safety, and to set up a new concept of "cooperative governance" in the external environment. It is necessary to improve the legal basis of food industry associations, reform the dual management system, enhance the main position of food industry associations in food safety governance, and improve the autonomous governance structure in the construction of the associations themselves. To strengthen the capacity building of the food industry associations themselves, to improve the industry representativeness of the food industry associations, to give play to the main position of the food industry associations in the construction of the food safety supervision system, and to give full play to their governance functions of self-regulation and supervision, In food safety management to play a due role in the function.
