【摘要】:随着我国经济的快速发展,环渤海地区的经济发展得到国家的高度重视。天津滨海新区纳入国家总体发展战略、唐山曹妃甸工业园区开发、环渤海多个沿海港口成为亿吨大港等,这就造成环渤海地区城市填海围垦筑港、道路建设以及房地产的开发对建筑用砂的需求量迅速增加,使得采砂和运砂行业随之蓬勃发展起来,砂石运输船舶安全问题也变得日益严峻。砂石需求量的日益加剧,水上砂石运输船呈现迅猛增长的势头。由于目前我国对砂石运输船的检验以及管理相对滞后,并且砂石运输市场暴利的存在,这导致影响水上交通安全的现象的频繁发生。 近些年来,渤海各类采、运砂船事故不断,既造成人身财产重大损失,又影响了海上主要航路的安全畅通,对重点船舶和大型船舶航行安全带来很大影响。砂船问题已成为水上交通安全的一大隐患,砂船的安全监管也是摆在我们面前亟待解决的问题。 近年来,由于渤海水域航行的砂石运输船舶超载、配员不足、超航区航行以及不遵守避碰规则等违章行为时有发生,已严重干扰了正常的水上交通秩序,给其他船舶的航行和人命财产安全构成了严重威胁。为维护水上交通安全形势稳定,促进社会主义和谐社会建设和经济社会协调发展,部海事局于2007年下发了《关于印发交通部海事局砂石运输船施工船舶安全管理专项整治活动方案的通知》,沿海砂石运输船舶已被列为近两年水上安全监管整治规范的重点。 本文主要是对渤海水域砂石运输、砂石运输船现状及相关部门监管情况进行全面的分析研究,深层次地剖析近年来砂石运输船事故多发以及安全隐患难以从根本上消除的原因。在现有国家体制及国情的基础上,结合国家有关监管政策和现有监管经验,从公共管理的角度提出相应的安全监管对策,研究制定一系列的砂石运输船监管方案和手段,建立并完善各级海事部门与有关职能部门的联系沟通机制,同时建立与港航企业相对应的联系制度,加强督促企业和船舶安全管理主体责任的落实,共同打造水上砂石运输安全责任产业链。从而最大限度减少砂石运输船事故发生,逐步形成砂石运输船的长效安全监管机制。
[Abstract]:With the rapid development of China's economy, the economic development around Bohai Sea has been attached great importance to by the state. Tianjin Binhai New area is included in the overall national development strategy, the development of the Caofeidian Industrial Park in Tangshan, the development of many coastal ports around the Bohai Sea, and so on. This has resulted in the reclamation and reclamation of ports by cities around the Bohai Sea. The demand for building sand is increasing rapidly with the development of road construction and real estate, which makes sand mining and sand transportation industry flourish, and the ship safety problem of sand and stone transportation becomes more and more serious. With the increasing demand of sand and stone, the ship of sand and stone on water is increasing rapidly. At present, the inspection and management of sand and stone carriers in our country lag behind, and the existence of huge profits in the sand and stone transportation market leads to the frequent occurrence of phenomena that affect the safety of water transportation. In recent years, the accidents of various mining and sand carrying ships in the Bohai Sea have not only caused great loss of life and property, but also affected the safety and unblocked navigation of the main navigation routes at sea, which have a great impact on the navigation safety of key ships and large vessels. The problem of sand ship has become a hidden trouble of water traffic safety, and the safety supervision of sand ship is also a problem to be solved urgently in front of us. In recent years, due to the overloading of sand and stone transport vessels in the Bohai Sea waters, the shortage of personnel, the frequent occurrence of illegal activities such as over-navigation in navigation areas and failure to abide by the rules of collision avoidance, the normal order of water traffic has been seriously disturbed. It poses a serious threat to the navigation of other ships and to the safety of life and property. In order to maintain the stability of the water transportation safety situation, to promote the construction of a harmonious socialist society and the coordinated development of the economy and society, In 2007, the Ministry of Marine Affairs issued the notice on issuing and issuing the special regulation plan for the safety management of sand and stone transport ships in construction of the Ministry of Communications. The coastal sand and stone transport ships have been listed as the key points of the regulation and regulation of water safety in the past two years. In this paper, the author makes a comprehensive analysis and research on the sand and stone transportation in Bohai Sea, the present situation of the sand and stone transport ship and the supervision situation of the relevant departments, and deeply analyzes the causes of the frequent accidents of the sand and stone transport ship and the difficulty of eliminating the hidden dangers of safety in recent years. On the basis of the existing national system and national conditions, combined with the relevant national regulatory policies and existing regulatory experience, this paper puts forward the corresponding safety supervision countermeasures from the perspective of public management, and studies and formulates a series of supervision schemes and means for sand and stone carriers. To establish and improve the mechanism of communication between maritime departments at all levels and relevant functional departments, and at the same time to establish a liaison system corresponding to port and shipping enterprises, and to strengthen the implementation of the main responsibilities of enterprises and ship safety management bodies, Jointly build water sand and stone transport safety responsibility industry chain. In order to minimize the occurrence of sand and stone ship accidents, the long-term safety supervision mechanism of sand and stone transport ship is gradually formed.
