河南省服务型行政执法建设研究

【摘要】：行政执法是政府进行公共管理的重要方面，也是政府从事各种具体行政行为的重要保障。而在当代中国，行政执法，特别是与百姓关系密切、社会关注度高的行政审批、行政处罚等领域，存在执法认同度低、执法效率低、易发生社会矛盾等问题。因此，新一届中央政府本着“简政放权”的原则，从行政审批等领域出发，对行政执法体制进行大力改革，带动全国上下对行政执法建设进行新一轮的探索实践。河南省结合自身实际，于2012年在全国率先提出推行服务型行政执法建设。虽然如何改善行政执法建设，始终是学术界极为关注的重要课题，但目前学术界专门对河南省服务型行政执法建设的研究还较为欠缺，故该论文关于此课题的研究具有一定的理论意义和实践价值。该论文运用服务型政府理论及依法行政理论，采用调查研究、实证分析、文献研究等方法，通过分析河南省实施服务型行政执法建设的背景、举措、成效，指出当前建设工作中存在的突出问题，并提出相应对策建议。通过研究，笔者认为，虽然目前河南省服务型行政执法建设仍处于起步阶段，部分举措的制定及落实有待完善，但其理念和目标与国家行政执法体制改革的精神和要求相契合，在对相关举措和制度进行健全完善后，必将对推动法治政府和服务型政府建设发挥巨大的促进作用。因而，作为行政执法体制改革的新路径，河南省服务型行政执法建设需要坚持推行、深化举措、确保成效。该论文的内容框架主要有四部分：第一部分简述河南省服务型行政执法建设提出的背景；第二部分对河南省服务型行政执法建设的主要举措及成效进行实证分析与总结；第三部分挖掘河南省服务型行政执法建设中存在的突出问题，并简要分析原因；第四部分基于研究的成果，，对河南省加强服务型行政执法建设提出具体意见建议。本文力图在借鉴现有研究成果的基础上，深入调研全省服务型行政执法现状，为下一步工作开展提供参考依据。
[Abstract]:Administrative law enforcement is not only an important aspect of government public management, but also an important guarantee for the government to engage in various specific administrative acts. In contemporary China, administrative law enforcement, especially in areas such as administrative examination and approval and administrative punishment, which is closely related to the common people and has a high degree of social concern, has problems such as low recognition of law enforcement, low efficiency of law enforcement, and easy to produce social contradictions. Therefore, the new central government, based on the principle of "decentralization of government administration" and proceeding from the fields of administrative examination and approval, makes great efforts to reform the system of administrative law enforcement, and drives the whole country to carry out a new round of exploration and practice on the construction of administrative law enforcement. In 2012, Henan Province took the lead in implementing the construction of service-oriented administrative law enforcement in China. Although how to improve the construction of administrative law enforcement has always been an important topic of great concern to the academic community, but at present, the academic research on the construction of service-oriented administrative law enforcement in Henan Province is still relatively lacking. Therefore, the research on this subject has certain theoretical significance and practical value. This paper uses the theory of service-oriented government and the theory of administration according to law, adopts the methods of investigation and research, empirical analysis, literature research, etc., through analyzing the background, measures and effects of implementing service-oriented administrative law enforcement construction in Henan Province. This paper points out the outstanding problems existing in the current construction work, and puts forward corresponding countermeasures and suggestions. Through research, the author believes that although the construction of service-oriented administrative law enforcement in Henan Province is still in its infancy, the formulation and implementation of some initiatives need to be improved, but its concept and objectives are in line with the spirit and requirements of the reform of the national administrative law enforcement system. After perfecting the relevant measures and systems, it will play an important role in promoting the construction of the government ruled by law and the service-oriented government. Therefore, as a new path of the reform of administrative law enforcement system, the construction of service-oriented administrative law enforcement in Henan Province should be carried out persistently, deepen the measures and ensure the effectiveness. The main contents of this paper are as follows: the first part briefly describes the background of the construction of service-oriented administrative law enforcement in Henan Province, the second part makes an empirical analysis and summary of the main measures and results of the service-oriented administrative law enforcement construction in Henan Province. The third part excavates the outstanding problems existing in the construction of service-oriented administrative law enforcement in Henan Province, and briefly analyzes the reasons; the fourth part, based on the research results, puts forward specific suggestions on strengthening the service-oriented administrative law enforcement construction in Henan Province. Based on the existing research results, this paper makes a thorough investigation of the current situation of service-oriented administrative law enforcement in the province, and provides a reference basis for the next work.
