民生视角下我国城市流动摊贩治理研究

【摘要】：本文系统地阐述了流动摊贩作为一种民生现象,在就业、满足城市居民对廉价商品的需求、传承民间文化、激发民间创新等方面起到了非常重要的作用。从我国经济体制的变迁,国有企业改组,城市化进程加快,城乡收入差距拉大等方面,全面地分析了城市流动摊贩形成的原因。深刻透视和剖析城市流动摊贩治理过程中矛盾冲突的诱因,如政府相关部门缺乏“民生”理念,对流动摊贩的治理政策机制滞后,执法方式落后等。提出并分析如何借鉴英、法、美、日发达国家和泰国、印度等一些发展中国家流动摊贩治理的成功经验。从政治学、法学、新制度经济学、公共管理理论和福利经济学几方面,论证了流动摊贩治理机制的创新。建议引进流动摊贩治理的社会机制,构建一个以民生为基础的“政社一体化治理模式”。启动社区自治,形成一个由政府定政策、社区管事务,上下一致、协同合作的治理机制。指出在“政社一体化治理模式”下,政府部门和社区都应树立以民生为出发点的治理理念对流动摊贩施以引导教育、依法治理。呼吁社会以宽容的态度对待流动摊贩这一弱势群体。并从规划用地、增添公共设施,提供经营和生活方面的咨询,建立和完善流动摊贩的诉求机制等方面,为他们提供良好的公共服务。即通过解决流动摊贩这一弱势群体的生计问题,达到城市流动摊贩的和谐治理。
[Abstract]:This paper systematically expounds that mobile vendors, as a livelihood phenomenon, play a very important role in employment, meeting the demand of urban residents for cheap commodities, inheriting folk culture and stimulating folk innovation. From the aspects of the change of our country's economic system, the reorganization of state-owned enterprises, the quickening of urbanization process and the widening income gap between urban and rural areas, this paper comprehensively analyzes the reasons for the formation of urban mobile vendors. This paper deeply analyzes the causes of contradictions and conflicts in the process of urban mobile vendors' governance, such as the lack of the concept of "people's livelihood" in the relevant government departments, the lagging of the policy mechanism for the management of mobile vendors, and the backward way of enforcing the law, etc. This paper puts forward and analyzes how to draw lessons from the successful experiences of mobile vendors in some developing countries, such as Britain, France, the United States, Japan, developed countries and Thailand, India, etc. From the aspects of political science, law, new institutional economics, public management theory and welfare economics, this paper demonstrates the innovation of the governance mechanism of mobile vendors. It is suggested that the social mechanism of the management of mobile vendors should be introduced, and a "integrated governance model of government and society" based on the people's livelihood should be constructed. Start community autonomy, form a government policy, community management affairs, up and down consistent, cooperative governance mechanism. It is pointed out that under the mode of integrated governance of government and society, government departments and communities should set up the concept of governance with people's livelihood as the starting point to guide and educate mobile vendors and administer them according to law. Call on society to be tolerant of mobile vendors this vulnerable group. And from the aspects of planning land, increasing public facilities, providing advice on management and life, establishing and perfecting the appeal mechanism of mobile vendors, and so on, providing them with good public services. That is, to solve the livelihood of the vulnerable groups of mobile vendors, to achieve the harmonious governance of urban mobile vendors.
