提高海南游艇海事公共服务水平研究

【摘要】：游艇产业在国外被称为“漂浮在黄金水道上的巨大商机”,海南省海域广阔、气候宜人、环境优美,发展游艇产业有着得天独厚的自然条件,且区位优势明显,对国内外的游艇旅游度假爱好者极具吸引力。尽管游艇产业在海南省拥有广阔的发展前景,但我国在游艇登记、检验、口岸管理、通航管理和游艇操作人员培训考试方面的立法相对滞后。由于缺少与游艇产业发展相适应的海事管理法规和公共服务体系,海事管理机构在涉及游艇的管控和提供公共服务产品上,一般参照适用于运输船舶的法律法规体系,客观上限制了游艇产业的发展。海南省将发展游艇产业作为建设海南国际旅游岛的重要举措,随着海南游艇产业的不断发展,解决海南游艇海事管理和公共服务方面的难题越发迫切。本论文利用新公共管理理论的原理分析了海南省游艇海事管理和公共服务现状,发现现行的海南游艇海事管理和公共服务机制从游艇登记、检验、现场监督、口岸管理、通航管理和游艇操作人员考试发证等方面都存在着绪多问题,客观上限制了游艇产业的发展；通过研究欧美等游艇业发达国家的游艇管理制度和公共服务产品的供给机制,借鉴它们先进的游艇管理理念和制度设计,结合海南省游艇的发展前景和社会法治状况,按照促进游艇业“安全、便捷”发展的海事公共管理和服务思路,提出切合海南实际的游艇海事监管模式和公共服务体系,解决目前在游艇海事管理方面不适应海南游艇产业发展需要的突出问题。论文由引言和四个部分组成：引言部分主要论述了选题的缘由和研究目的和意义,对国内外有关游艇公共管理和服务的研究文献进行综述,阐明了本研究的思路和研究方法；第一部分对服务型政府、公共安全、海事公共服务、游艇等概念的内涵进行论述,对新公共管理理论的原理和指导意义进行了归纳,指出海事公共服务和游艇业发展存在着必然联系；第二部分分析了海南游艇产业发展现状,重点分析了海南游艇海事管理现状和存在问题,指出游艇在登记、检验、现场监督、口岸管理、通航管理和游艇操作人员考试发证等方面存在的问题,海事部门在引导政府和第三部门为游艇业的发展提供公共服务产品方面没有发挥应有的作用。第三部分研究发达国家游艇公共管理发展历程,分析它们成熟的游艇管理理念和经验作法对海南游艇海事管理的启示。第四部分是本研究的重点,通过用新公共管理理论为指导,借鉴发达国家游艇公共管理经验,针对海南省游艇海事管理和公共服务存在的问题,提出以海事监管、行业自律和自主管理相结合的安全管理模式,有前瞻性地建立有别于商船且相对独立的游艇安全监管制度；提出了海事部门必须引导地方政府为游艇提供必要的公共服务产品,以促进游艇业的健康发展。
[Abstract]:The yacht industry is called "the huge business opportunity floating on the golden waterway" in foreign countries. Hainan Province has a vast sea area, a pleasant climate and a beautiful environment. The development of the yacht industry has unique natural conditions and obvious geographical advantages. For domestic and foreign yacht tourism holiday enthusiasts are very attractive. Although the yacht industry has a broad development prospect in Hainan Province, the legislation on yacht registration, inspection, port management, navigation management and yacht operator training examination in China lags behind. Due to the lack of maritime management regulations and public service systems suitable for the development of yacht industry, maritime management agencies generally refer to the system of laws and regulations applicable to shipping vessels when it comes to the control of yachts and the provision of public service products. Objectively it limits the development of yacht industry. Hainan Province will develop yacht industry as an important measure to build Hainan international tourism island. With the continuous development of Hainan yacht industry, it is more and more urgent to solve the problems of maritime management and public service of Hainan yacht. This paper analyzes the current situation of maritime management and public service of yachts in Hainan Province by using the theory of new public management, and finds out that the current maritime management and public service mechanism of yachts in Hainan Province include yacht registration, inspection, on-site supervision and port management. There are many problems in navigation management and examination and license issuance of yacht operators, which objectively limit the development of yacht industry. By studying the management system of yachts and the supply mechanism of public service products in developed countries such as Europe and America, and drawing lessons from their advanced concept and system design of yacht management, combined with the prospect of the development of yachts in Hainan Province and the situation of social rule of law, According to the idea of maritime public management and service, which promotes the development of "safety and convenience" in yacht industry, this paper puts forward the maritime supervision mode and public service system suitable for Hainan. To solve the outstanding problems in the maritime management of yachts that are not suitable for the development of Hainan yacht industry. The paper is composed of four parts: the introduction mainly discusses the reason, research purpose and significance of the topic, and summarizes the domestic and foreign research literature on the public management and service of yachts. The ideas and methods of this study are expounded. The first part discusses the connotation of service-oriented government, public safety, maritime public service, yacht and so on, and summarizes the principle and guiding significance of the new public management theory. It is pointed out that there is an inevitable connection between maritime public service and the development of yacht industry. The second part analyzes the current situation of Hainan yacht industry development, mainly analyzes the current situation and existing problems of Hainan yacht maritime management, points out that yacht registration, inspection, on-site supervision, port management, There are some problems in navigation management and the examination and certification of yacht operators, but the maritime sector has not played its due role in guiding the government and the third sector to provide public service products for the development of the yacht industry. The third part studies the development course of yacht public management in developed countries and analyzes the enlightenment of their mature yacht management concept and experience to Hainan yacht maritime management. The fourth part is the focal point of this research, through using the new public management theory as the guidance, drawing lessons from the experience of yacht public management in developed countries, aiming at the existing problems of maritime management and public service in Hainan Province, the author puts forward the maritime supervision. The safety management mode of combining self-discipline and autonomous management in the industry, which is different from the merchant ship and relatively independent of the yacht safety supervision system; In order to promote the healthy development of the yacht industry, the maritime department must guide the local government to provide the necessary public service products for the yacht.
