社会中介组织参与我国医疗纠纷治理的研究

【摘要】：近几年来,随着生活水平的提高,人们的健康意识也逐渐增强,对医疗卫生服务的期望也越来越高,同时由于法律意识增强,某些卫生机构医务人员医德滑坡,部分患者无力承担高额的医疗费用等,这些原因使医患关系紧张,医疗纠纷逐年上升。目前我国医疗纠纷数量不断上升,医患矛盾不断激化,呈现出常态化、高额索赔、恶性故意伤害、群体性闹事等状况,已经严重影响了医院正常的工作和社会的和谐稳定。本文将医患纠纷的治理作为研究的目标,运用政治学的公共治理理论和社会治理理论,从政治学的角度分析医患纠纷的治理,引出构建和谐医患关系需要社会中介组织参与,需要构建一个新的社会中介组织模型来解决医疗纠纷。本文分为六部分内容,对社会中介组织参与我国医疗纠纷的治理进行研究探讨。第一部分阐述了本文的选题背景、选题意义以及研究综述。第二部分对公共治理理论、社会治理理论及相关概念进行梳理,着重对公共治理理论和社会治理理论的产生、背景、发展、内涵和功能进行剖析,找出治理理论对解决医疗纠纷的指导价值。第三部分对我国现阶段医疗纠纷的基本情况做了详细的描述,强调解决医疗纠纷已是迫在眉睫的事情,影响着社会的和谐安定。第四部分对我国现阶段医疗纠纷解决机制进行评析,指出现阶段的解决机制存在很多局限性,必须有新的方式介入医疗纠纷治理。第五部分总结国内外社会中介组织介入医疗纠纷治理的经验,找出对我国医疗纠纷治理的启示。第六部分思考构建新的社会中介组织模型参与医疗纠纷治理。
[Abstract]:In recent years, with the improvement of living standards, people's health awareness is gradually enhanced, the expectation of medical and health services is also higher and higher. At the same time, due to the increase of legal awareness, medical ethics of medical personnel in some health institutions has declined. Some patients can not afford the high medical costs, these reasons make the doctor-patient relationship tense, medical disputes rising year by year. At present, the number of medical disputes in China is rising, doctor-patient contradictions continue to intensify, showing normality. High claims, malicious intentional injury, mass disturbances and other conditions have seriously affected the normal work of hospitals and social harmony and stability. This paper takes the management of doctor-patient disputes as the goal of the study. Using the theory of public governance and social governance of political science, this paper analyzes the governance of doctor-patient disputes from the angle of political science, and draws the conclusion that the construction of harmonious doctor-patient relationship needs the participation of social intermediary organizations. Need to build a new social intermediary organization model to solve medical disputes. This paper is divided into six parts. Social intermediary organizations to participate in the governance of medical disputes in China are studied. The first part describes the background of this topic, the significance of the topic and a summary of research. The second part of the public governance theory. The theory of social governance and related concepts are combed, focusing on the emergence, background, development, connotation and function of the theory of public governance and social governance. Find out the guiding value of governance theory to solve medical disputes. The third part describes the basic situation of medical disputes in China at present and emphasizes that it is urgent to solve medical disputes. Impact on social harmony and stability. 4th part of the medical dispute resolution mechanism in China at the present stage, pointed out that there are many limitations of the current mechanism of medical dispute resolution. There must be a new way to intervene in the management of medical disputes. Part 5th summarizes the experience of intervention of social intermediary organizations in medical dispute management at home and abroad. To find out the enlightenment to the management of medical disputes in China. 6th part of thinking about the construction of a new model of social intermediary organizations to participate in the management of medical disputes.
