权力清单与地方政府职能转变——以苏州市相城区为例

【摘要】：权力清单是推动政府职能转变的重要政策举措,它要求依据法律法规梳理各项权力,实现政府职能法治化与规范化。但是,从地方政府实践观察,权力清单存在的问题包括权力边界不清、权力清单制度化不足、下放权力的衔接以及事后监管缺位等,是一些带有普遍性的问题。从地方政府职能转变的结果上看,权力清单改革还没有达到预期政策目标,基层治理尚未得到明显改善。因此,地方政府要把权力清单与政府职能转变实质性地关联起来,核心是明确不同主体的权力边界,切实由审批职能向监管职能转变,发挥社会组织的服务功能,调整和完善评价机制与责任机制。
[Abstract]:The list of powers is an important policy measure to promote the transformation of government functions. It requires combing all powers according to laws and regulations to realize the rule of law and standardization of government functions. However, it is observed from the practice of local governments. The problems existing in the list of powers include unclear boundaries of power, inadequate institutionalization of lists of powers, convergence of delegated powers and lack of supervision after the event. As a result of the transformation of local government functions, the reform of the list of powers has not yet achieved the expected policy objectives, and grass-roots governance has not yet been significantly improved. Local governments should link the list of powers with the transformation of government functions substantively. The core is to make clear the power boundary of different subjects, to change the function of examination and approval to the function of supervision, and to give play to the service function of social organizations. Adjust and perfect the evaluation mechanism and responsibility mechanism.

【正文快照】： 地方政府职能转变的有效性,一方面取决于顶层制度设计的合理性,另一方面是落实到基层治理革新上。从顶层设计来看,简政放权是转变政府职能的一个关键,因此,权力清单改革举措的出笼,就是要对政府权力规范化、制度化,目标是将政府与社会、市场的关系确立在法治规范的基础之上。
