重庆市农村土地流转中的政府责任研究

【摘要】：农业是人类社会发展的重要依托,也是一个国家繁荣富强的基础。随着现代科学技术的进步,农业的机械化、规模化日益成为一种普遍的发展趋势。现阶段我国农村土地的细碎化仍是制约我国农业规模化生产的重要因素,而解决这一问题的关键在于我国农村土地流转制度的创新。农村土地流转制度是中国土地使用制度的重大变革,其实质是农村土地资源的重新配置。其中,作为农村各项政策的制定者和农业规模经营的推动者,政府在促进农村土地流转快速发展、规范农村土地流转市场秩序中发挥着不可替代的作用。2008年以来,全国各地政府纷纷因地制宜,探索建立适合当地情况的土地流转制度。本文选取以“大城市带大农村”为典型特征的重庆市作为考察对象,系统分析重庆市政府在推进农村土地流转中的政府责任落实情况,并就存在的问题提出解决对策。文章共分六个部分。第一部分“导言”介绍了课题研究的意义和背景,简要说明了本文的研究思路和研究方法。在第二部分,作者综合介绍了国内外学者对“土地流转过程中的政府责任”问题的研究成果,通过文献综述来厘清国内外学者已经取得的研究成果,仍存在的不足等,为本研究开展提供宽广的视野。在第三部分,作者详细介绍了农村土地流转与政府责任的相关概念,探讨了政府在农村土地流转承担责任的理论依据,并将政府责任初步分为“行政责任”、“法律责任”和“道德责任”,并分析了政府落实责任的手段。第四部分作者通过大量的调研数据着重介绍了重庆市农村土地流转的概况,并就政府责任落实存在的问题进行了探讨。第五部分则根据重庆市具体情况提出强化土地流转政府责任的对策。第六部分为结论部分,对全文取得的成绩和不足做了简要分析,并提出进一步研究的打算。农村土地流转是一个系统性工程,也是我国“破解城乡二元结构”难题的关键性举措。希望通过对重庆市在推进土地流转中政府责任落实情况的探讨,能为创建更加合理、有效的土地流转制度提供有益借鉴。
[Abstract]:Agriculture is not only an important support for the development of human society, but also the basis for a country's prosperity and strength. With the progress of modern science and technology, the mechanization of agriculture, Scale is becoming a general trend of development. At this stage, the fragmentation of rural land in China is still an important factor restricting the large-scale production of agriculture in China. The key to solve this problem lies in the innovation of the rural land circulation system in China, which is a great change of the land use system in China, and its essence is the reconfiguration of the rural land resources. As the policy maker of rural areas and the promoter of agricultural scale management, the government plays an irreplaceable role in promoting the rapid development of rural land circulation and standardizing the market order of rural land transfer. Governments all over the country have taken measures according to local conditions to explore the establishment of a land transfer system suitable for local conditions. This paper selects Chongqing, which is characterized by "big cities with large rural areas" as the object of investigation. This paper systematically analyzes the implementation of government responsibility in promoting the transfer of rural land by Chongqing Municipal Government, and puts forward solutions to the existing problems. The article is divided into six parts. The first part, "introduction", introduces the significance and background of the research. In the second part, the author synthetically introduces the domestic and foreign scholars' research results on the issue of "government responsibility in the process of land transfer". In the third part, the author introduces the concepts of rural land transfer and government responsibility in detail. This paper discusses the theoretical basis for the government to assume responsibility in the rural land circulation. The author divides the government responsibility into administrative responsibility, legal responsibility and moral responsibility, and analyzes the means of implementing the responsibility of the government. 4th part of the author emphatically introduces the general situation of the rural land circulation in Chongqing through a large number of investigation data. The paper also discusses the problems existing in the implementation of government responsibility. Part 5th puts forward countermeasures to strengthen the government responsibility for land transfer according to the specific conditions of Chongqing. Part 6th is the conclusion part, and makes a brief analysis of the achievements and shortcomings of the full text. And put forward the intention of further research. The rural land circulation is a systematic project. It is also a key measure to solve the problem of "solving the dual structure of urban and rural areas" in China. It is hoped that the discussion on the implementation of government responsibility in promoting land transfer in Chongqing will provide useful reference for the establishment of a more reasonable and effective land transfer system.
