政府职能转变视角下的专业性调解

【摘要】：政府职能的属性之一是其历史变动性。政府的社会管理职能转变,涉及调整和重塑政府与社会的关系,专业性调解是政府与社会主体关系发生变化的一个体现。专业性调解委员会作为相对中立的社会主体,在解决矛盾纠纷和参与社会治理、促进地方政府社会管理职能转变过程中,发挥了重要功能,其实践运作显示了政府与社会关系调整的一种发展方向。地方政府向社会放权和转移职能的重要条件在于,确定调解组织相对独立于政府的性质定位,以法律法规形式明确可转移职能的范围,提升社会主体的规范化制度化运作,加强政府的监督角色。
[Abstract]:One of the attributes of government function is its historical variability. The transformation of government's social management function involves adjusting and reshaping the relationship between government and society. Professional mediation is a reflection of the change in the relationship between the government and the social subject. As a relatively neutral social subject, the professional mediation committee is involved in resolving contradictions and disputes and participating in social governance. In the process of promoting the transformation of the local government's social management function, it has played an important role, and its practical operation has shown a developing direction of the adjustment of the government-to-social relationship. The important condition for the local government to delegate power and transfer the function to the society lies in, It is necessary to define the nature of mediation organization which is relatively independent of the government, to define the scope of transferable functions in the form of laws and regulations, to promote the standardized and institutionalized operation of social subjects, and to strengthen the supervisory role of the government.
