地方政府光伏发电政策执行偏差研究

【摘要】：公共政策是政府各部门为促进某特定群体或行业发展所制定的一系列法律、法规、细则、规定、措施、通知、公告等。本文所研究的光伏发电政策即是政府在光伏发电产业领域的公共政策。光伏发电产业作为未来提供能源供应的重要产业,尤其是在当前应对气候变暖的低碳发展思路下,国家促进光伏发电产业的发展更具有重要的现实意义和战略意义。中国地区的太阳能资源丰富,且开发利用前景也较为广阔。随着世界各国对光伏发电产业扶持政策的竞相出台,中国政府也己经从国家战略层面发布了众多光伏发电产业政策,以促进光伏发电产业更好的发展。政府执行则是政府运用各种手段和资源将政策条款转化为现实实践的一个过程。这一过程涉及各层级政府机构或部门以及与政策目标群体之间的互动行为。本文通过光伏发电企业与地方政府部门的互动行为发现,地方政府对国家颁布的政策在执行上出现了各种偏差,如对绿色能源电价补贴政策的选择性执行、对路条买卖政策、土地税政策的曲解式执行和附加式执行,这给光伏发电企业带来了沉重的时间压力和财务损失。究其原因,除政策制定时本身存在界定宏观模糊、政策缺乏自上而下的整体设计外,作为政策执行主体的地方政府在等级权威的底端,滥用其自由裁量权而谋取部门利益是主要的原因所在,由此,使得作为政策目标群体的各光伏发电企业不得不与地方政府进行谈判和利益的博弈,以最小化其损失。以一窥百,化解光伏发电政策执行出现偏差的措施应从合理化政策制定、政策执行的内外部环境及政策执行主体对所执行政策的认同方面入手,特别是要将地方政府的自由裁量权予以明确限定,上级政府应对下级政府实行有效的监督以杜绝政府各部门从自身利益出发而导致政策执行的偏差。
[Abstract]:Public policy is a series of laws, regulations, rules, regulations, measures, notices made by various government departments to promote the development of a particular group or industry. The photovoltaic power generation policy studied in this paper is the public policy of the government in the field of photovoltaic power generation industry. Photovoltaic power generation industry as an important industry to provide energy supply in the future, Especially in the current low-carbon development thinking of climate warming, the national promotion of photovoltaic power generation industry has more practical and strategic significance. China is rich in solar energy resources. And the prospects for development and utilization are also relatively broad. With the introduction of support policies for the photovoltaic power generation industry in various countries around the world, the Chinese government has also issued a number of photovoltaic industry policies from the national strategic level. In order to promote the better development of photovoltaic power generation industry, government implementation is a process in which the government uses various means and resources to translate policy provisions into practical practice. This process involves government agencies or departments at all levels and the government. Based on the interaction between photovoltaic power generation enterprises and local government departments, Various deviations have appeared in the implementation of the policies promulgated by local governments to the state, such as the selective implementation of the policy of subsidizing the price of green energy electricity, the policy of buying and selling roads, the misinterpretation of the policy of land tax and the implementation of the additional type of implementation. This brings heavy time pressure and financial loss to photovoltaic power generation enterprises. The reason is that, except for the macro ambiguity and the lack of top-down overall design when the policy is made, At the bottom of the hierarchical authority, the local government, as the main body of policy execution, abuses its discretion and seeks for the interests of the department, which is the main reason. In order to minimize the losses, the photovoltaic power generation enterprises, which are the target groups of the policy, have to negotiate with the local government and play a game of interests, so as to minimize their losses. In order to solve the deviation in the implementation of the photovoltaic power generation policy, the measures should be made from the rationalization policy. The internal and external environment of policy implementation and the identification of the policy implementing subject to the policy implementation, especially the discretion of local government should be clearly defined. The superior government should carry out effective supervision to prevent all government departments from deviating from the implementation of policies in their own interests.
