论监察委员会体制的异体监察模式

【摘要】：作为反腐的专门机构,监察委员会应当是异体监察,这是良好监察制度的必然要求,是我国多年来监察实践的经验与教训总结,也是域外监察实践的有益启示。目前我国试点中的监察委员会,没有按照异体监察体制进行很好的设计,人事管理体制上受制于地方,财政供给体制上不能独立于地方,难以实现对公职人员的有效监察。在异体监察体制设计中,最关键的是要处理好监察委员会与党的领导及人民代表大会制度的关系。监察委员会体制改革必须接受党的领导,但并不一定是接受所有层级党组织的领导,可直接受中共中央的领导,实行垂直领导,不受地方党委的干预;要坚持人民代表大会制度,但并不是让所有层级的权力机关介入其中,要由全国人大及其常委会对监察委员会的主要人员进行任命,无须地方权力机关的介入。同时,要实现监察委员会独立的财政支付,彻底摆脱对地方的依附和地方对监察委员会工作的不当干预。
[Abstract]:As a specialized agency for anti-corruption, the supervisory committee should be an alien supervision, which is an inevitable requirement of a good supervisory system and a summary of the experience and lessons learned from the practice of supervision in China over the years. It is also a useful revelation from the practice of extraterritorial supervision. At present, the supervisory committee in China's pilot projects has not carried out a very good design according to the alien supervisory system, the personnel management system is restricted to the local authorities, and the financial supply system cannot be independent of the local authorities. It is difficult to carry out effective supervision of public officials. In the design of an alien supervisory system, the most important thing is to properly handle the relationship between the supervisory committee and the leadership of the Party and the system of the people's Congress. The reform of the supervisory committee system must accept the leadership of the Party. However, it is not necessarily to accept the leadership of party organizations at all levels, but to be directly under the leadership of the CPC Central Committee, to exercise vertical leadership and not to be subject to the interference of local party committees; it is necessary to uphold the system of people's congresses. However, not all levels of power should be involved. The NPC and its standing Committee should appoint the key members of the supervisory committee without the involvement of the local authorities. At the same time, it is necessary to realize the independent financial payment of the supervisory committee. Get rid of local attachment and improper local interference in the work of the supervisory committee.
