国家治理现代化中道德与法律的关系论析

【摘要】：法安天下,德润人心。作为国家治理的两个基本手段,道德离不开法律,法律也离不开道德,二者的关系集中体现为内容上相互吸收、功能上相互补充、实施上相互促进。从内容契合角度看,法律是成文的道德,道德是内心的法律。在国家治理中,道德精神与制度理性、道德原则与法律原则、道德规范与法律规范相互吸收、相互体现。从功能互补角度看,法律与道德的治理功能有着诸多不同,必须实现二者治理范围的宽窄互补、治理要求的高低互补、治理重点的权责互补、治理强度的刚柔互补、治理路径的内外互补。从实施互促角度看,法律的有效实施有赖于道德支持,道德践行也离不开法律约束,法治和德治不可分离、不可偏废,国家治理现代化需要法律和道德协同发力。
[Abstract]:Peace in the world, run the heart of the people. As two basic means of national governance, morality can not be separated from law and law can not be separated from morality. The relationship between them is embodied in mutual absorption in content, mutual supplement in function and mutual promotion in implementation. From the point of view of content agreement, law is the written morality and morality is the inner law. In national governance, moral spirit and institutional rationality, moral principles and legal principles, moral norms and legal norms absorb each other and embody each other. From the perspective of functional complementarity, the governance functions of law and morality have many differences. It is necessary to realize the complementation of the scope of governance between the two, the high and low complementation of governance requirements, the complementation of power and responsibility of key points of governance, and the reinforcement and flexibility of governance intensity. Governance path of the internal and external complementary. From the point of view of mutual promotion, the effective implementation of law depends on moral support, and the practice of morality cannot be separated from the rule of law. The modernization of national governance needs the concerted efforts of law and morality.
