责任政府建设中的行政问责制

【摘要】：有多大权力,就要负多大责任,权力与责任,两者不可缺一。任何责任都不是自动实现的,制度性的责任要靠强力的问责机制才能实现。行政问责制的践行有利于公共权力合法性的保证,有利于遏制权力寻租与腐败,更有利于中国责任政府的建设,从我国全面实施行政问责制到当前,问责制也取得了很多成果,并不断走向制度化、法制化和规范化。论文对责任政府、行政问责制以及行政问责力的相关内涵要义进行了梳理总结,而行政问责制在践行过程中也出现了问责主体单一、问责前瞻不足且连续性差、问责法规匮乏、官员责任意识淡漠、问责制执行力低下等问题,症结在于行政责任理念的淡薄、官本位思想浓厚、法律制定的位阶低、行政问责主体的缺位、起复评估制度缺失、公开透明监督不够、责任处理难落实等,为完善行政问责制提出了相应的对策建议,包括：强化问责主体的功能、完善问责体系、加强问责的连续性、加强责任伦理建设、加强行政问责力的量化研究及其应用,其中行政问责力评价体系的构建,对完善行政问责制提供了一种新的解决思路。由于资料和实践经验的限制,对于行政问责力评价指标体系的构建仍然处于初步探索的阶段,然而关注行政问责力及其评价体系,有利于将行政问责制的执行力进行量化研究、将效果评价与规则制度结合起来,以至于推进责任政府构建的进程。
[Abstract]:How much power, must bear the responsibility, the power and the responsibility, both must one. Any responsibility is not automatic, the institutional responsibility can only be realized by strong accountability mechanism. The practice of the administrative accountability system is conducive to the guarantee of the legitimacy of public power, the containment of power rent-seeking and corruption, and the construction of China's responsible government. From the full implementation of the administrative accountability system to the present, the accountability system has also achieved a lot of results. And continue to institutionalize, legalization and standardization. The paper summarizes the relevant connotations of responsible government, administrative accountability system and administrative accountability power, and in the process of implementation of administrative accountability system, there is a single accountability body, lack of accountability foresight and continuity, lack of accountability laws and regulations. The crux of the problem lies in the weak concept of administrative responsibility, the strong ideology of officialdom, the low level of law making, the absence of the subject of administrative accountability, and the absence of the system of complex evaluation. Some countermeasures and suggestions are put forward to improve the administrative accountability system, such as strengthening the function of the subject of accountability, perfecting the accountability system, strengthening the continuity of accountability, strengthening the construction of responsibility ethics, and so on. To strengthen the quantitative research and application of administrative accountability, the construction of evaluation system of administrative accountability provides a new solution to improve the administrative accountability system. Due to the limitation of information and practical experience, the construction of the evaluation index system of administrative accountability is still in the initial stage of exploration. However, paying attention to the administrative accountability and its evaluation system is conducive to the quantitative study of the executive power of administrative accountability. It combines the effect evaluation with the rule system, so as to promote the process of responsible government construction.
