奉化市行政审批制度改革研究

【摘要】：行政审批制度曾在资源配置、市场调控、保障公共环境等方面产生了积极的影响。然而,随着我国社会主义市场经济的不断发展,相关的体制建设也在不断完善,过去的行政审批制度因其具有一定的局限性,慢慢的难以适应现有的经济发展,不但没有起到促进经济发展的作用,反而在一定程度上阻碍了经济的发展。所以,全国各地政府部门纷纷开始并加快对行政审批制度的改革与创新。本文拟从寻租理论、善治理论和新公共服务理论入手,从笔者工作所在的奉化市的现行制度出发,分析其在发展中存在的问题,并参考国内外有益的改革经验,针对未来发展给出可行的对策。奉化市政府从2001年开始,在行政审批制度改革方面做了大量工作,如行政审批职能归并,确定合理的审批标准,减少审批等待时间,清理审批项目,探索模拟审批和以会商会审为主的联合审批工作机制,开展以项目清理、服务承诺、建立信用等级为主要内容的涉及行政审批中介机构管理工作等。近年来,奉化市在深化行政审批制度改革,转变政府职能,提高办事效率上作出了一定的努力,并且取得了一定成效。然而,奉化市在制度改革上仍然存在问题,比如,设定的数量仍然偏多、中介服务参差不齐制约着审批体制改革、一些部门改革不够彻底、窗口工作人员素质仍有待提高等。问题的主要原因是部门利益阻碍、政府职能转变滞后以及缺乏有效的市场监管机制。因此在看到自身不足的同时,需要吸取别人的成功经验。国内以武汉市、安吉县、象山县为例,国外以美国、日本为例,总结国内外行政审批制度改革的可用经验,同时对其采取的具有创新性思维的手段进行探索,从奉化市发展的现状出发,为奉化市深化改革提出对策建议:进一步合理选择审批项目,促进审批高效化、建立联审联办机制、提升中介服务机构水平、完善行政审批工作监督机制等。
[Abstract]:The administrative examination and approval system has had the positive influence in the resources allocation, the market control, the protection public environment and so on. However, with the continuous development of China's socialist market economy and the continuous improvement of related institutional construction, the past administrative examination and approval system, because of its certain limitations, is slowly difficult to adapt to the existing economic development. Not only did not play a role in promoting economic development, but to some extent hindered economic development. Therefore, government departments all over the country have begun and accelerated the reform and innovation of the administrative examination and approval system. Starting with the theory of rent-seeking, the theory of good governance and the theory of new public service, this paper analyzes the problems existing in the development of Fenghua City, where the author works, and refers to the beneficial reform experience at home and abroad. The feasible countermeasures are given for the future development. Since 2001, the Fenghua Municipal Government has done a great deal of work in the reform of the administrative examination and approval system, such as merging the administrative examination and approval functions, determining reasonable examination and approval standards, reducing the waiting time for examination and approval, and clearing up the examination and approval items. This paper explores the mechanism of simulated examination and approval and joint examination and approval based on consultation and review, and carries out the management work involving administrative examination and approval intermediary organizations with the main contents of project cleaning, service commitment and establishing credit rating. In recent years, Fenghua City has made some efforts in deepening the reform of the administrative examination and approval system, transforming government functions and improving the efficiency of work, and has achieved certain results. However, there are still some problems in system reform in Fenghua City. For example, the quantity of establishment is still on the high side, the intermediary service is uneven, the examination and approval system reform is restricted, the reform of some departments is not thorough enough, and the quality of window staff still needs to be improved. The main causes of the problem are the obstruction of departmental interests, the lagging of government functions and the lack of effective market supervision mechanism. Therefore, we need to absorb the successful experience of others when we see our own shortcomings. Taking Wuhan City, Anji County and Xiangshan County as examples, and taking the United States and Japan as examples abroad, this paper sums up the available experiences of the reform of administrative examination and approval system at home and abroad, and explores the innovative thinking methods adopted by them. Based on the present situation of Fenghua City's development, this paper puts forward some countermeasures and suggestions for further deepening the reform of Fenghua City: further rational selection of examination and approval items, promotion of high efficiency of examination and approval, establishment of a joint audit office mechanism, promotion of the level of intermediary services, Improve the administrative examination and approval work supervision mechanism.
