民间公益组织的“道德契约”约束研究

【摘要】：社会组织在弥补“政府失灵”、“市场失灵”的同时,由于各种原因也会出现“志愿失灵”。那么,社会组织是否可能、如何可能克服“志愿失灵”就是一个迫切需要解决的理论和现实问题。本文以民间公益组织为考察对象,结合理论与实证研究,提出了“道德契约约束论”。“道德契约”由领导者(道德)感召力、公益使命、社会问责、赠与合同、志愿者成就感与归属感五个变量构成；在组织成长与运行中形成了类似于企业“利润硬约束”的约束力,不断鞭策着民间公益组织追求卓越；其中,领导者感召力是民间公益组织的内部软约束,公益使命是内部硬约束,社会问责是外部软约束,赠与合同是外部硬约束,志愿者成就感与归属感是民间公益组织发展的持久动力。“道德契约约束论”解释了民间公益组织克服“志愿失灵”何以可能,从而为进一步提出民间公益组织的内外部治理模式提供了参考。其政策意义在于为政府应该“重点培育和优先发展行业协会商会类、科技类、公益慈善类、城乡社区服务类社会组织”,以及上述四类社会组织免主管单位登记注册,提供了理论佐证。
[Abstract]:Social organizations make up for "government failure" and "market failure" at the same time, because of various reasons will also appear "voluntary failure." Therefore, whether and how social organizations can overcome the "voluntary failure" is an urgent theoretical and practical problem to be solved. Based on the theoretical and empirical research, this paper puts forward the theory of moral contract restraint. "moral contract" consists of five variables: the charismatic power of the leader (moral), the public welfare mission, the social accountability, the gift contract, the volunteer's sense of achievement and the sense of belonging. In the growth and operation of the organization, it forms a binding force similar to the firm's "hard restriction of profit", and constantly drives the folk public welfare organizations to pursue excellence; among them, the leader's appeal is the internal soft constraint of the folk public welfare organization. The public welfare mission is the internal hard constraint, the social accountability is the external soft constraint, the gift contract is the external hard constraint, and the volunteer sense of achievement and the sense of belonging is the lasting motive force for the development of the folk public welfare organization. The Theory of the restraint of moral contract explains why it is possible for civil public welfare organizations to overcome "voluntary failure", and thus provides a reference for further proposing the internal and external governance model of folk public welfare organizations. Its policy significance lies in the fact that the government should "focus on fostering and giving priority to the development of trade associations, chambers of commerce, science and technology, public welfare and charity, urban and rural community service social organizations," and the above four social organizations should be exempted from registration by competent units. It provides theoretical evidence.
