基层治理体系现代化研究

【摘要】:完善和发展中国特色社会主义制度,推进国家治理体系和治理能力现代化作为我国全面深化改革的总目标以来,国内社科界对国家治理体系的概念、国家治理体系的现代化进行了广泛而深刻的研究,其中对基层治理体系的研究成为了国家治理体系研究的一个具体领域。关于我国基层治理体系的研究成果中,视角选择不乏有城市中的社区、农村中的村社,将视角定位于乡镇的研究则少之又少,而乡镇基层治理体系是我国基层治理体系中的重要组成部分并不容忽视,因此,以乡镇为视角对我国基层治理体系及其现代化的研究是有意义的。乡镇基层治理体系是一个具有结构性的系统,由两个子系统构成,即乡镇基层治理主体与乡镇基层治理机制,两者依据自身的性质在乡镇基层治理体系中发挥各自的功能,以维持乡镇基层治理体系的存在并实践乡镇基层治理体系在乡镇基层治理进程中的作用,这种乡镇基层治理体系的分析模式是对结构—功能主义的借鉴。 国家治理体系的内涵注重政治、经济、社会等方面的制度意义,而乡镇基层治理体系的内涵在注重制度意义的同时,更要具体到治理主体与治理机制。在治理主体方面,与国家治理体系一致,乡镇基层治理主体是多元的,不仅要充分肯定乡镇党委的领导地位与乡镇政府的主导作用,也要重视乡镇派驻机构与社会力量的补充性意义。在治理机制方面,与国家治理体系相异,乡镇基层的立法体制是缺失的,鉴于国家政治体制的现实,只能承认乡镇基层治理机制的相对不完整性,但是在较为特殊的民族乡开展立法工作的尝试是值得肯定的。不同阶段的乡镇基层治理体系拥有其独有的特点,国家发展的历史与现实造就的乡镇基层治理体系现状必须得到正确的认识,在认识到因推崇乡镇党委领导地位与乡镇政府主导作用而实现乡镇基层经济快速及优质发展等成就的同时,也要意识到因乡镇派驻机构与社会力量的补充性治理效能尚未得到充分发挥而出现的乡镇基层政治与社会活力低等不足:在关注乡镇党委对乡镇政府与社会的领导体制、乡镇中行政体制与干部管理体制对乡镇基层治理的主要作用时,也不能忽视乡镇中立法体制的缺失与司法体制的微弱作用为乡镇基层治理带来的弊端。因此,必须对乡镇基层治理体系进行结构与功能两个方面的法治化、民主化、科学化、有效化的现代化改造。
[Abstract]:Since perfecting and developing the socialist system with Chinese characteristics and promoting the modernization of the national governance system and governance ability, as the overall goal of comprehensively deepening the reform in our country, the concept of the national governance system has been put forward by the domestic social science circles. The modernization of national governance system has carried out extensive and profound research, among which the research on grass-roots governance system has become a specific field of national governance system research. Among the research results of our country's grass-roots governance system, there is no lack of the community in the city, the village community in the countryside, and the research on the orientation of the perspective in the township is rare. The township grass-roots governance system is an important part of the grass-roots governance system in China and can not be ignored. Therefore, it is meaningful to study the grass-roots governance system and its modernization from the perspective of township. The township grass-roots governance system is a structured system, which is composed of two subsystems, namely, the main body of township grass-roots governance and the township grass-roots governance mechanism, both of which play their respective functions in the township grass-roots governance system according to their own nature. In order to maintain the existence of the township grass-roots governance system and practice the role of the township grass-roots governance system in the township grass-roots governance process, the analysis model of the township grass-roots governance system is a reference to structure-functionalism. The connotation of national governance system pays attention to the political, economic, social and other aspects of the institutional significance, while the connotation of the township grass-roots governance system pays attention to the institutional significance, but also to the governance of the main body and governance mechanism. On the subject of governance, in line with the national governance system, the main body of governance at the grass-roots level in villages and towns is pluralistic, not only should the leading position of the township party committees and township governments be fully affirmed, but also the leading role of township governments should be fully affirmed. We should also attach importance to the supplementary significance of township agencies and social forces. In terms of governance mechanisms, different from the national governance system, the legislative system at the grass-roots level in villages and towns is lacking. In view of the reality of the national political system, we can only recognize the relative incompleteness of the governance mechanism at the grass-roots level in villages and towns. However, the attempt to carry out legislative work in more special nationality townships is worthy of recognition. Different stages of the township grass-roots governance system has its unique characteristics, the history of national development and the reality of the status quo of the township grass-roots governance system must be correctly understood. While recognizing the achievements of promoting the leading position of the township party committees and the leading role of the township government in realizing the rapid and high quality development of the township grass-roots economy, We should also be aware of the inadequacy of the low political and social vitality at the grass-roots level in villages and towns, which have not yet been fully brought into full play by the supplementary governance effectiveness of the accredited agencies and social forces in villages and towns: the attention paid to the leadership system of the township party committees over the township governments and the society, When the administrative system and the cadre management system in the township play a major role in the governance of the township grassroots, the defects brought by the lack of the legislative system and the weak role of the judicial system in the township can not be ignored. Therefore, it is necessary to carry on the modernization reform of the structure and function of the grass roots governance system of villages and towns in the aspects of law, democratization, science and efficiency.
