我国行政审批制度改革中寻租问题的治理研究

【摘要】：行政审批是政府管制的重要内容,是一种利益再分配机制。从2002年到2014年,在“放”与“管”两个轮子的驱动下,行政审批历经了八个阶段的渐进式改革。改革的共同特点是：国务院取消、调整、下放行政审批事项,改变实施部门,合并同类审批。改革在一定的时期促进了社会经济的发展,但是也滋生了严重的寻租问题。审批寻租及其治理在行政审批制度改革中处于十分重要的地位。本篇论文是基于寻租治理研究我国审批制度改革,找出问题的原因并提出可行性的治理对策。论文的主要内容包含四个部分：一是通过对国内外文献的梳理,找到研究薄弱的环节。发现基于寻租治理来研究行政审批制度改革的比较少,且寻租得以有效治理的话,能够减少权力腐败,深化行政审批制度改革。二是在把握寻租的概念、理论假设后,通过审批寻租分析,发现在政府和政府官员、企业、个人三个利益主体之间,作为两种结构密致型组织、利益集团的政府和企业在审批过程中寻租的影响力度大。不仅领导干部、审批人员会进行权力寻租,地方政府也进行横向和纵向的寻租。企业在审批申请中,通过寻租与政府、政府官员也是频繁互动。三是站在寻租治理的角度,研究国外基于寻租治理的行政审批制度改革的状况,借鉴国外的经验,为最后一章的对策部分服务。站在寻租治理的角度,分析我国行政审批制度改革取得的成效,存在的问题,存在问题的原因,认识到行政审批中存在寻租,不利于深化行政审批制度改革。第四部分是论文的最后部分。针对审批寻租存在的问题,改革不到位的原因,提出包括合理界定政府权力边界,转换政府职能,加大监督力度,加强软文化建设等对策,基于寻租治理研究行政审批制度改革。
[Abstract]:Administrative examination and approval, an important content of government regulation, is a kind of benefit redistribution mechanism. From 2002 to 2014, under the drive of two wheels of "put" and "pipe", administrative examination and approval have undergone eight stages of gradual reform. The common characteristics of the reform are: the State Council abolished, adjusted, put down administrative examination and approval matters, changed the implementation department, merged the same The reform has promoted the development of social economy in a certain period, but has also caused serious rent-seeking problems.
The examination and approval of rent-seeking and its governance are very important in the reform of the administrative examination and approval system. This paper is based on the study of the reform of the examination and approval system in China, to find out the reasons for the problems and to put forward the feasible countermeasures. The main contents of this paper include four parts:
The first is to find out the weak links by combing the literature at home and abroad. It is found that the reform of the administrative examination and approval system based on rent-seeking governance is relatively small, and the search for renting to effective governance can reduce the power corruption and deepen the reform of the administrative examination and approval system.
The two is to grasp the concept of rent-seeking, after the theoretical hypothesis, through the examination and approval of rent-seeking analysis, found in the government and government officials, enterprises, individual three stakeholders, as two kinds of structure of dense organization, the government and enterprises of the interest groups in the process of seeking rent in the process of the great influence. Not only leading cadres, the approver will be in search of power. Local governments also engage in horizontal and vertical rent-seeking. Enterprises often interact with government and government officials in the examination and approval process through rent seeking.
The three is to stand on the angle of rent-seeking governance, to study the situation of the reform of the administrative examination and approval system based on rent-seeking governance in foreign countries, draw lessons from foreign experience and provide some services for the Countermeasures of the last chapter. In the view of rent-seeking governance, the results of the reform of the administrative examination and approval system in China, the problems existing, the reasons for the problems and the recognition of the administrative examination and approval are also made. Rent-seeking is not conducive to deepening the reform of the administrative examination and approval system.
The fourth part is the last part of the paper. In view of the problems existing in the examination and approval of rent-seeking, the reasons for the reform are not in place, and the countermeasures are put forward, including the rational definition of the boundary of the government power, the conversion of government functions, the strengthening of supervision, the strengthening of the construction of soft culture and so on, and the reform of the administrative trial approval system based on rent-seeking governance.
